Timeline

Hi guys, my case is a bit dicey, I filed my N-400 in early February, my wife divorced me in the same month. Well, I had filed based on the 3yrs eligibility, and because of this unprecedented incident, I wrote uscis that I will appreciate if my application is withdrawn since my wife had divorced me. But to my utmost surprise, I got an email that I should go ahead and do my biometric and that my case will be treated since it was filed before the divorce became final and I wasn’t the one that filed the divorce. Could someone in same shoe as mine enlighten me. My wait time is currently 6 months. Still waiting on interview.

I think the person gave u wrong information. To my understanding, if you apply under the 3 year rule ,you should still be married to your spouse up to the day of the oath ceremony.

I agree with the above poster, that it’s unlikely that you’ll be approved under 3 year rule if you are divorced. Especially since you stated that your wife divorced you in the very same month when you filed - that means you were separated prior to filing, am I right?

 

is your timeline accurate - is removal of conditions pending for you as well?

 

Since the fee won’t be reimbursed there’s probably no harm in trying. You might get lucky after all. But be prepared for a denial at the interview stage.

Well, we’d never separated, and I wasn’t aware my wife filed a divorce until a sheriff showed up with a divorce citation. We had no issues that I know off, and of course I had already my 10yrs green card. Like I said, when I discovered she’d filed a divorce, I emailed uscis and opted to withdraw my N-400 application. But I instead got a letter to go for biometric. They said that, I filed in the space of my 3 years eligibility and that I was qualified. So they asked me to go and do fingerprints, I did that and my case was updated immediately. Whatever it is, I can wait. I mean I can apply for 5yrs eligibility next year. It’s the same thing

Wow - I’m sorry you had to go through this. Character wise it sounds like you’ll be better off without her 😶


Please update your timeline and profile, as it will help giving you better advise.

 

As I mentioned above I’d just roll with it and see what happens, since you already filed. Best case they’ll approve you, worst case you’ll have to re-file once you become eligible under 5 year rule. Please keep us posted what happens!

How many people have received a rescheduled interview? My case still says the estimated completion date is July. They are nothing, if not optimistic.

Yes Since yesterday all Offices are open. They are updating this on daily basis. 

My estimates time is December 2020. I dont see or heard any new Interviews dates at all.

 

01/14/2020 - filed N400 Miami FL

01/18/2020 - NOA Biometric scheduled 

02/05/2020 - Biometrics done 

03/13/2020 - Interview scheduled - canceled due Covid19

08/19/2020 - Interview 

08/27/2020 - OATH Ceremony MIAMI FL 

Done with USCIS  !!!! Good luck everyone!

Weird to be closing offices for one day and then not the next, perhaps on a deep cleaning schedule?

The N-400 was filed in February and I got biometric done on March 6th before the lockdown. I just went through the INA 319(a). I think the uscis email to me was right. It states that if the spouse is in continual mutual marital status and living together for 3 years preceding the filing. Not after the filing, take note of that. Although, I am not too worried, I will be eligible for the 5yrs type next year, so no big deal. But I think, if called for interview, I will be favored and will be approved. Below is the copied related law, INA 319(a)

(a) Any person whose spouse is a citizen of the United States, or any person who obtained status as a lawful permanent resident by reason of his or her status as a spouse or child of a United States citizen who battered him or her or subjected him or her to extreme cruelty, may be naturalized upon compliance with all the requirements of this subchapter except the provisions of paragraph (1) of section 1427(a) of this title if such person immediately preceding the date of filing his application for naturalization has resided continuously, after being lawfully admitted for permanent residence, within the United States for at least three years, and during the three years immediately preceding the date of filing his application has been living in marital union with the citizen spouse (except in the case of a person who has been battered or subjected to extreme cruelty by a United States citizen spouse or parent), who has been a United States citizen during all of such period, and has been physically present in the United States for periods totaling at least half of that time and has resided within the State or the district of the Service in the United States in which the applicant filed his application for at least three months.

Hello everyone, i have been visiting our thread everyday and it seems the process is on a halt at the moment. My status just changed today we are taking longer than usual to process at the moment which i am not surprised at all but hoping to recieve something in the near future for the schedule of interview.
