The CO will immediately suspect the old shuffle here - have a baby with a local woman, “break up”, meet an American, get a K-1, come to the US, divorce, marry child’s mother and petition her. This happens all the time. Be prepared for intense scrutiny. 

Well we met on Facebook in August of 2017. We were friends at that time. But we continue to talk of course and get closer. But we were not in a relationship yet I guess but we felt a chemistry. I met my kid mother around December of 2017. I never knew if or when I would ever met my now fiance in person so I guess in the beginning we didn't take the relationship as serious, but we did talk daily and our relationship was getting stronger. I traveled to Liberia from February to April of 2018 for soccer trial. I came back to Sierra Leone I hooked up with my bby mother for the first time and we dealt with each other from April until july of 2018. I regret it now, but we never really considered the relationship more then sex, but in July the bby was conceived and delivered in April of 2019. My now fiance found out about the bby around November of 2018 about a month before we met for the first time and of course she was upset but we worked it out and we met for the first in December of that year. I feel bad about everything but the bby is here now and I'm taking care of the bby along with my family and my fiance is helping as well.

With the timelines overlapping like that, will be somewhat difficult for you to prove the relationship with your fiancee is a valid one.

 

One statement that struck as a bit odd...was that at the time you said your relationship with your fiancee was getting stronger was around the same time you said you hooked up with the child's mother.

 

I have to hand it to your fiancee, however.  Not too many women would be that understanding with a baby being conceived with another woman while in a relationship, not being told about the baby until several months later (sounds like you have no choice but to "fess up" about the child's existence right before she was set to fly out), and then be immediately accepting of all of that and also be willing to immigrate the child as well (with no issues from the child's mother who is also willing to let the baby go---possibly not seeing the child again until much later). 

 

Off-the-cuff, as mentioned earlier it will sound like a bait-and-switch to the CO.

I told her about the bby as soon as I found out. After the last time I hooked up with my bby mother in April we didn't speak at for months. Later I started to hear that the girl was pregnant and she was saying that I was the father. Our families had meeting about the situation and I agreed that its possible that I'm the father. I told my fiance soon after. The love I have for my future wife is real no bait and switch. It was a mistake but I owed it to my fiance and to my bby to man up and handle the situation as best as I could. I thank my fiance every day for her continued support and understanding in all of this. The bby is almost 9 months now and the relationship between my fiance and I  has grown even stronger over time. With my fiance even coming to Sierra Leone and spending months with me and the bby as a family unit. My bby is her future step child and we plan on raising him up as a family. I have no interest or intention with the bby mother.

Not us you have to convince---members are just pointing out what you may face with the CO later on down the road.

 

Just an observation...some of what you have stated here seem to contradict with things you have stated earlier.  For example saying the below:

I'm not saying you are outright lying about any circumstances or trying to hide things---but imagine what a well-trained CO can do when trying to pick out any discrepancies in your story to determine a valid relationship.  Best of luck to you.

I'm not saying you are outright lying about any circumstances or trying to hide things---but imagine what a well-trained CO can do when trying to pick out any discrepancies in your story to determine a valid relationship.  Best of luck to you.

Ok well we were dealing with each other between the months of April to July. Afterwards I didn't hear anything from her until around November. Around that time it had gotten to my family that the girl was claiming me for the pregnancy. Soon after our families had a meeting and I admitted that it's a possibility that the bby could be mine. As soon as I found out I told my fiance. It was hard but I let her know anyways and convinced her to still come and meet me. Like I  said before she was up set but she came. We settled the issue and have moved Forward at this point. And here we are now a year later. The bby is here my fiance has met him and spent more then 2 months with the bby and we would like to live as a family together. I'm aware of how it may look from the outside looking in especially from a co point of view. But they must understand that no relationship is perfect and things happen but that doesn't truly mean that there is no love or true relationship. I will just be honest. I want to know that I have the documents needed to take the bby, I dont mind telling my whole story to the co, I want to have letters if needed and other things as well.

While you may not meet the requirements for a CR-1 visa, it still sounds like you may be considered "too married" for a K-1.

As odd as it sounds, you can be in a middle ground where you don't qualify for either visa as-is.

The burden is always on the applicant to demonstrate that they qualify for the benefit being sought. So for a K-1, you must demonstrate that you are free to marry. A marriage ceremony may result in the CO believing otherwise. You cannot challenge their decision with a K-1. So K-1 still seems risky IMO.

A better option would be to both travel to another country and marry there then do a CR-1.

 

Edit: Also, a denied CR-1 can have the petitioned reaffirmed. A denied K-1 will die and you have to start over from scratch.

Nothing changed on the thread, maybe mix something things up while typing in a hurry but my facts are the same

How can u do a cr1 if the marriage is not valid.

you are right . it is happening everyday and the timeline is so quick. you don't have to be CO to figure this out.
