request for additional information but confused...

Hi, we got a request for additional information. It says that my husband did not sign a part of one of the forms, but when we look at the forms they sited where he missed a signature it says "Petitioner" not petitionee. If I'm the one with the US citizenship, aren't I the Petitioner? Doesn't that mean we filed correctly since I had signed that spot? We are very confused and would like some advice please!

 No for the ROC the none usc is the petitioner.

The immigrant is the petitioner for the I-751.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

ROC is the immigrant's petition, that means the immigrant is the petitioner. Needless to say the USC doesn't need to remove any conditions as s/he doesn't have a greencard, so there is no way the USC can be the petitioner. 

 

The immigrant is also the beneficiary, as it is the immigrant that gets the benefit of the removal of conditions. 

 

The US citizen is "nothing" but a signature as the spouse of the immigrant petitioner/beneficiary.

Technically you are filing a joint petition at this point, but petitioner here is referring to the non-USC.

A USC does not need to petition for ROC...it's the permanent resident that needs to remove conditions.

Do you know if we have to send just the page they are requesting back or the whole form?
