The OP has not given any indication that he can or cannot pass on citizenship to the child. For all we know, he may have only become a citizen yesterday.

OP is a USC what more do you need?     He is a USC and he resides in the USA, he stated both of these details.

REQUIREMENTS FOR TRANSMISSION OF US CITIZENSHIP AT BIRTH

In order to transmit U.S. citizenship to a child, the U.S. citizen parent(s) must have been a U.S. citizen at the time of the child’s birth and must have accrued sufficient physical presence in the U.S. to transmit citizenship.  The physical presence requirements depend on the child’s date of birth and the marital status of the parents at the time of the child’s birth.

Are you ignoring the AND that is after your underlined section for a reason?

YMMV

While it is very likely the OP meets the requirements to pass citizenship to the child, it is not a certainty. It's a valid question.

K-2 would never apply here, though. Or CR-2...but an IR-2 would.

Would K1 Visa be the right one though? I copy you on the CRBA and thanks!

'Supposedly' she is due sometime September 2020. Would you think the K1 Visa be approve by then?

If she is due in September 2020... how is it possible she knows that she’s? Takes at least a month to work that out...  9 months pregnancy... 9 months until September. It’s still December. 🤷‍♀️ Are you sure she’s pregnant?

Good question. Unless there was a serum test to verify pregnancy (those can show positive results after only 7-10 days from conception), you're likely talking early December at the soonest for conception that would show on an OTC test. Sept. would be at least 10 months out...very, very unusual for a due date.

Somebody who conceived within just the past week - still not verifiable with any test - might have a due date of late Aug/early Sept.

Hmm I think I need to duck out of this and leave it to the experts.

Correct..... If she’s worked it out like the majority of women it’s more likely late July early August exptancy date.. with conception November early December at the most. Especially when you take into account ovulation and other fun stuff..

generally speaking you don’t consider a serum test unless desperately trying for a baby or after pee test shows positive to confirm true reading.. because you’d just be thinking your timing is out or miscounted blah blah.. highly unlikely you go get a serum test when just a day or two late, which would have to be the case for a September baby in which case blood test still wouldn’t pick it up just yet

Agreed, although there are a few other circumstances...

1) If being considered for certain medical procedures or treatments, they may require a serum test if there is any possibility of having conceived. idk the process everywhere, clearly, but this is the case at my wife's hospital prior to things like most non-OTC pain killers being prescribed or other medical procedures that could impact a pregnancy.

2) idk how the UAE is, but some countries in that region have severe consequences for women who become pregnant while unmarried. As such, it's not uncommon to have an OTC or even serum test right away if there is any chance of conception having occurred.

But yeah, the timing in this case doesn't add up. Miscalculation? haha

Sorry everyone for the delay since i've been busy with work. First off, I would like to thank for everyone's helpful comments. We are going to be going a different route (CR-1), so I would be starting a new thread soon in that section of this forum.

Again, thank you all so much and I am really surprised at how active/helpful everybody is in this forum. Thank you!
