CSPA sibling, path forward

Timeline

So an I-130 was submitted for a son of an LPR  on 11/27/2017 (the date on NOA)  who's born on 12/13/1997 (19 at the time) 

the approval date was 11/01/2019 

the date the F2A became current was on July 2019

the status on NVC shows a visa class of F24 (I guess that means F2B)

 

my questions:

1.Does CSPA apply in this case ?

2. If it does, how can it be invoked ?

1. CSPA is applicable.

2. Contact NVC and tell them his cspa age is around 19 years based on 2 years of i130 processing.

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

This question is a continuation of a question that I asked (to which @arken so kindly replied)

 

The background is as follows :

LPR submitted i-130's for her 3 children, we recently have gotten the approvals and contacted by NVC

 

1. One who is  close to 30. 

2. The one mentioned above (over 21 but CSPA applies)

11/27/2017 (the date on NOA

date of birth 12/13/1997 (19 at the time) 

the approval date was 11/01/2019 

 

3. One who is currently below 21 of age (10 month to 21)

 

when we input the case and invoice ID numbers in the NVC portal we see:

 

  • for sibling number 1 (30 years old) the status on the NVC website says : "not eligible for further processing at this time"
  • for sibling number 3 (below 21) we were able to pay the visa fees (120$) and affidavit of support fees (325$) and now we are able to start the application 
  • for sibling number 2 (the cspa child) we were able to pay the visa fees (120$), but now there is no path forward.

We further sent an email to nvcattorney@state.gov requesting the case of sibling number 2 to be reviewed for CSPA consideration.

 

my questions are:

 

What do you think our next steps should be? is it appropriate to use the "add applicant" button and add the CSPA sibling to the application of the younger sibling?

update, checked again and inexplicably the category for sibling 2 changed from F24 to F22, now we are able to pay the Affidavit of support fee.

 

I-130 sent: 1/27/2017 

1-130 approved : 11/01/2019 

contacted by NVC : 12/20/2019
