Re-Submission Timelines

I recently got an RFE and had to resubmit our AOS, they have accepted all our other documents, so I guess that’s a positive.

 

My question is around the timelines for reviewing resubmissions, do we go back to the start of the queue, or are we treated differently?

Timeline

Any time you submit a new document or resubmit a document it’s back to the end of the line

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

2 weeks to 30 days applies to even most those who’ve submitted the first time, these days. I guess you could say there isn’t even really a line at all with how all over the place reviews are but at the very least there’s no special treatment

It really seems very random. We submitted our documents first time around, and they gave us a RFE within five days. After our resubmission, it took almost six weeks for DQ. To say I was frustrated by the inconsistency would be an understatement! But, it will come eventually. Just try and put it out of your mind for the next month and be happily surprised when it appears!

I assume OP is probably talking about NVC, since they talked about their other documents being “accepted”, I think by resubmitting AOS they meant “affidavit of support” and not “adjustment of status” but I guess OP can correct me if I’m wrong

Your probably right,  but you don't really get RFEs from NVC

No but I’ve seen a lot of people call them that though like OP has, whenever a document is requested or rejected. They said they got “RFE” and had to “resubmit AOS” so by that I assume they mean their affidavit of support at NVC since if you get an RFE for a petition, you don’t typically resend the entire petition.. at least I hope no one does that

@LilyJ You’re correct, we’re at the NVC stage and they are requesting that we resubmit our Affidavit as we did not qualify to use the EZ version (which we did, pretty confused why it was rejected). 
 

 @payxibka I used RFE in the post as they requested additional evidence of income, my bad, I just assumed that was an RFE.

It’s incredibly frustrating, especially as we do actually qualify for the affidavit they’re saying we don’t. Congrats on your DQ!

It's strange but not the first time that I've heard of them requesting I864 instead of I864EZ from those who should have been able to use the EZ, it's a fairly common request from NVC though I don't know why. But yes unfortunately the wait starts over again with no special treatment. We were request to submit an additional document on 12/18 and did so the same day and are still waiting, not expecting anything for at least another few weeks 😕

I know, I’ve seen it before on here. I want to call them and ask why it wasn’t accepted, but I know that they’ll not be able to do anything. We resubmitted on 12/27 so hopefully by Jan at least. Good luck with yours!

It's a really weird thing, I don't understand why they reject it from those who qualify for it, but I think there's many things we'll probably never understand about NVC! Yeah, when we called them about our additional document request (because it's not stated on any of the instructions or websites that we needed the document), they basically just said "oh well, your fault, submit it and we'll get to it when we get to it". Ughh. Thank you and good luck with yours as well! Let's hope we both hear good news this month
