I797C Rejection for extra remittance

My partner is on a K-1 visa, now married we filed AOS form I-485 together with AP I-131 form, sending the correct fees, according to instructions on the I-485 instructions. We paid those fees (currently $1140 application + $85, total $1225) using credit card payment along with the supplied G-1450 form. Things seemed to be going fairly well, albeit slowly possibly because the slow November/December holiday season timing of our application: Our credit card deduction was made (as seen on our statements), USCIS notified us that the biometrics fee was received, and we received an email notice our application was received and in process and to wait 7 to 10 days for an I-797, notifying us of the status. Things looked very good.  Good until today that is, when we received an unexpected I-797C (see attached image) with the ‘Notice Type’ box filled in with the words ‘rejection notice’, the ‘case type’ and ‘receipt number’ boxes were empty. The notice itself stated that our ‘form was submitted with an extra remittance not required to process your application’ and the remittance is being ‘returned to you’ and ‘no additional action is required by you at this time’. The note added that the submitted G-1450 form, used to make the credit card payment, ‘has been destroyed’. There was no check or monies attached, only a copy of the USPS Priority Mail label package mailed to them. Nothing more of importance given us.
 

We are thinking everything is okay though since we received several indications the application was in process but want to see if anyone else has seen anything like this along with some guidance.

OMG who is WORKING on these things? 

We got our i765 rejected because we didn't include the last 3 pages which would have been left blank anyway, but it also said "missing or improper fee"  Hello? the work authorization application is INCLUDED IN THE PRICE when filed with the i485!

 

And all this after waiting 30 full days to even hear anything!

Missing blank pages is still an incomplete form.  They have no way of knowing whether the missing pages were N/A or just omitted.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

And I get that.  I really do.  But the line about missing or incomplete payment threw me for a loop.  I'm guessing it was an error on their part, but I want to make sure that they won't double charge us which is why I am waiting 512 minutes for a level two agent to call me back!

You can send a copy of the NOA1 you received for the I-485 with the new I-765 paperwork.  That should eliminate all doubt about any incorrect fee.......

Just an update to our situation: The original posting. After much frantic worrying, poring over instructions and then finally a call back from the USCIS help center we learned finally USCIS screwed up and sent us the wrong notice!! Think we should be allowed one mistake of our own now. Not sure how they can expect us to be infallible when they can’t get basic stuff right.Very painful process!

They don't expect people to be infallible. Humans make mistakes and this is still a very human process.

In this case, they sent an incorrect notice. Your case was not delayed. You don't have to take any action. While I 100% get the inconvenience and stress it may have caused (that's not how I want to spend my NYE!), it's a pretty minor error.
