Visa refused for my wife and my boy with personal need

Hello 

can anyone can help me ?

my wife and my son with personnal need went to interview at overseas since April 2018 the consulate refused to give therm visa and ask for the boy health traitement estimation cost plus insurance l try to get insurance for the boy but all insurance companies refused to cover the boy asking social security number what l can not get if the boy is not in US 

now l become citizen and l send my naturalization certificate to the embassy 

since  they answer saying the will contact me for deferent options but l have not Hear from therm since October 

please need advice . 

 Is there anything l have to do ?

Are you trying to get insurance for your son through your employer's health insurance? SSN is not required. 

The immigration process caused me PTSD.

It is unfortunate, but this is a common rule that is being enforced more with those with medical conditions.  You have to prove that your son's medical care needs will not cause him to be a public charge.  Such as your wife not being able to work, his care needs needing government support such as daycare, nutrition, medical care, financial welfare (SSI)

Do you have employer health insurance? Or where do you get insurance from? It seems you just need an estimate for now, not actually adding him yet, to show you can afford it. If you have an employer plan it should be fairly easy to provide documentation showing how much extra it will be to add dependents once they arrive. 

Im not sure how to get the cost of treatment without a specific doctor/hospital treatment plan, but you may very well find that there is an online parent support group of this problem, and they may have good suggestions on there. Good luck.

You are now a US citizen?

The boy needs an I-864w if he's your biological child.  But the consulate may require you file a new I-130 for your son as the immediate relative class doesn't allow for derivatives like the Family of Permanent resident class does. 

Why would you leave your special needs son in another country while your wife and his mother immigrates to the USA? 

Also as mentioned, your son doesn't need an SSN to get health insurance.  Companies will tell you that, but it's not required and if you push they will eventually figure this out.

You need to show how much the costs are expected to be and that they can be afforded so he does not become a public charge. Actual coverage prior to entry is not required.

 

Becoming a US citizen does not negate the public charge issue (at least for the spouse). It also disqualifies the child from immigrating due to the petition for the mother. Unless you filed a separate petition for each already, the child will need one now.

 

Has this been sitting since April 2018? What has happened with the case since then? Are you sure the petition is still even at the consulate? What steps have you taken in the over 1.5 years to show what the costs will be and how they will be paid?

last October  after l get my naturalization certificate l send it and affidavit off support l-864 to the consulate they answer me saying they will contact me latter for for different options 

but since l did not hear from therm a mounth l contact me again for update but they don’t answer me yet 

l also call NVC and the USCIS both say the case is with the overseas embassy And as the went to interview already l don’t need to file another I-130 for the boy and they Can not do anything l have to deal with the consulate 

now l am confused l don’t know if they consulate is waiting for visa to be avalable or  is still need more from me

When it comes to health insurance, this shouldn't be an issue if it's employer insurance. Both of my children are on my husband's employer insurance, they have been for 7 years and 3 different employers. They are my biological children, not his.

I think it was reference to if they are subject to the public charge inadmissibility still or not. If biological, presumably they would become a USC upon entry, and use an I-864W now because they are exempt.
