Timeline

Hello everyone 

Just looking for the light at the end of the tunnel on our little situation.

Back in October I went with my husband for the interview (they requested me there for more proof of our relationship)my husband was denied the visa  due to his medical. They stated we would have to wait a year which will be August 2020 for him to redo the medical showing no indication of that good stuff (y’all know what I’m talking about)and then we will be able to continue. She did go ahead and questioned us both regarding our relationship and said that based on her finding our relationship is genuine. But my question is what happens next? When he completes the medical everything is good will he get the visa or is there going to be more needed???”

Timeline

He has to have regular drug tests to prove that he is clean for the entire year.  After the year, he can redo his medical, get an updated police certificate.  You will have to email the embassy to get a new interview date.  You will need to have updated paperwork, like taxes, I-864, etc....

Phase I - IV - Completed the Immigration Journey

Thank you for ur response I do have a couple questions lol

So how does he suppose to go about doing these regular drug test bc they didn’t say that at the interview and they also didn’t say anything about getting a police certificate should he just provide it anyways so this won’t be a surprise to us. The lady said we will pick up where we left off once the medical shows clear so sounds like she didn’t give complete information 😣

You might be able to "pick up" where you left off, but many of your required documents will have expired and need to be refreshed

This is why u have VJ to give you complete details on what to do. He will have to go to his doctor and get drug tested at a minimum 4 times in a year.  Anything that is expired will need to be resubmitted/updated.

Yes and I appreciate this so much. I’m glad I asked! I guess we will have to start in January with getting the 1st drug test done and he goes every 2 months bc August is only 8 months away. And Thank God taxes will be done in January/February he can have those documents and all he will need to get is the new police records. I definitely appreciate all the info is there anything else I would need to know. Like when he do the drug test does he just keep all the paper work until that interview? Or will they need to be submitted over? Sorry for all the questions just want to make sure everything is right this has already been the longest process for us already

Make sure to keep a copy of all the drug test results to take to medical appt and have for interview.

If somebody denies it and they find out, that person would have a bigger problem than a 1 year ban....misrepresentation is a permanent ban.

A "Material Misrepresentation" CAN result in a permanent ban from the US, but the misrepresentation must be deemed material.  Not a simple as it sounds.  ANY misrepresentation is really bad idea.

Agreed. Although I think lying about drug usage to avoid an inadmissibility would very likely fall under being material. ;)
