You peeps are making a SIMPLE thing very confusing!!

For one you don't need an ITR thats been excepted by IRS.

Just submit a copy of the ITR you are or have submitted. Tax transcripts are better but not required.

K1 can get SSN until 14 days prior to I-94 expiration and can work until such time.

K1 and K3 can apply for EAD and then get SSN also.

K3s have to wait until they get their GC to get SSN unless they get EAD.

Waste of money to apply for EAD if you are applying for AOS as it takes [unless RFE] as long or longer to get EAD than you get GC.

Waste of time and money also to apply for advanced parole as it takes as much time to get as the GC also!

Bottomline is get your AOS application in before 7/30/2007 unless you want to pay $1,010 instead of $395!!!

Even if it means you may get a RFE. No biggy! You save bucks and maybe lose a week or so.

One person that was transferred to CSC got their GC without interview and didn't even submit ITRs.

Yes, fees will go up, and I don't see big difference in all this too, I filled only AOS.

But see, the case is, he didn't come here on any kind of visa.

09/07/2006 - Warsaw embassy sent packet 3 (damn post services, never received any)

09/18/2006 - packet 3 sent (Nothing fails)

10/10 - medical exam

10/19 - INTERVIEW!

10/20 - received visa

11/7 - arrived in USA, POE YFK

02/23/2007 - Civil Surgeon (checked just vaccines for $ 25)

05/04/2007 - AOS package sent to Chicago

05/11/2007 - NOA1

05/15/2007 - NOA2 - ASC appointment letter about biometrics

05/24/2007 - RFE about tax forms w-2 and 1099!!!

06/05/2007 - Biometrics

21/06/2007 - NOA3 - Transfered to California

10/07/2007 - AOS approved, card production ordered!!!

19/07/2007 - Half year marriage anniversary - GC arrives!!!

07/08/2009 - Package sent (My cover letter 40 peaces of evidence)

07/14/2009 - check was cashed

07/10/2009 - NOA 1 received, GK extended for a year

07/17/2009 - received biometrics letter with my case number

08/06/2009 - scheduled biometrics appointment

11/16/2009 - approval

12/01/2009 - touched - card production ordered

2/26/2010 - got ten year card

That is what I was wanting to know...if I can just submit the ITR...just didn't know what to call it! We were going to apply for AP as his daughter is getting married in Nov 2007 and didn't want to chance it. We can handle waiting til the GC for him to work.

For those that came on a visitor's visa and got married after coming here, I wonder if their applications take longer than usual or is it the same for others filing AOS?

Good luck. Things happen, and you never know. They are picky about some people and some things they let by. Till time they might ask for RFE, you can get everything ready, why not to take risk then.

We sent everything of everything, but still got RFE, because they are great in loosing things.

I cant think of any reason why it should take longer, there is lucky cases and not so lucky. Maybe only if they get worried about visa fraud - coming here with intentions to get married.

For those that came on a visitor's visa and got married after coming here, I wonder if their applications take longer than usual or is it the same for others filing AOS?

My husband was on a tourist visa and our entire process from filing to approval took less than 2 months. This is not the norm, but there's no proof that adjusting from something other than K1 or K3 will take longer. A lot of the K1s get transferred to CSC and wait for a long time to get adjusted sans interview.

If he came on a visitor visa, he can't get an SSN until he has his EAD. My husband never got an EAD since our interview came so fast, so he had to wait until he got his green card.

The beginning of April my husband and I filed taxes (Married filing jointly) We sent it to the office in Austin TX with the W7 form (App for Individual Tax Identification Number or ITIN) We cannot get a SSN until he gets his EAD. I have waited to send his AOS and EAD paperwork until I could include 2006 tax return since 2005s was insufficient. To make a long story short, our ITIN and Tax return was suspended stating insufficient documentation. When I called today it was discovered that I DID have sufficient documentation but someone mistakenly suspended it. I was told we would have to resubmit (waiting another 6 weeks!)

So knowing that I probably have another couple of months before I get my completed tax return, I need advice on whether I should wait for the completed return to send the AOS and EAD out or can I send them now with a copy of the W-2s and a copy of the 1040 that I submitted to the IRS. We were married back in October 2006 but like I said was waiting to send the AOS and EAD til I had proof of income (completed 2006 tax return) If I can just send the W-2s and the 1040 with his paperwork then I can get the VJ process started sooner.

I would send the w-2,s out and not worry about it. At least you will beat the july 30 deadline for the fee increases and get the biometric appointment. Worst case scenario probably would be an RFE like I got for not sending in a 1099 but that' no big deal, they gave me 87 days to submit it. We were K-3 and could'nt get a SSN either. I figure if that's all we got we will be good to go soon. Good luck

Thanks for ALL of your help. I've gotten good advice from everyone! First, I will send out our I-130, I-485, and will spend the extra $170 for the I-131 in case it does take longer than November (can't chance his missing his daughter's wedding). We WILL wait for the GC for him to work as it really isn't a hardship at this time. So at least we will save $ in not filing an I-765. I will send my w-2s AND the 1099. By the time anyone even sees the packets, the IRS will have our resubmitted return (going out Priority today) and all will be OK there. As for showing proof of intent, that is OK there as well. We have proof to show he didn't intend to marry on a visitor's visa. We did so much at the last minute that we almost didn't make the deadline for him to return! But in hindsight, to avoid any suspicions, it is wise to wait for a correct visa so there is NO question about intent.
