My husband is a US citizen and I’m not, that’s why I took a health check.

You don't need to transfer it.   You can list it on the I-864.  Unfortunately it does not sound like your attorney knows what they are doing in this case.   Typically the beneficiary is not in the US.  Your assets can be taken into account.

If you have already submitted the AOS package with a I-864 it is a long wait for an interview, a year or more depending on your USCIS office, and in that time you are in a period of "authorized stay" until the AOS is adjudicated, as long as you entered the US legally and got married before you overstayed.  If you go to the AOS interview and the officer decides that you need a joint sponsor, you will have time to find one.  You may be approved on your husband's income alone if he takes proof of current income (6 months of pay stubs, letter from employer) as well as the most recent IRS tax return.  If you are denied LPR status at the AOS interview and you can't find a joint sponsor in the time they give you, you may have to leave the USA.  Good luck! 

I’m sorry if my English or lack of knowledge confused everyone. I thought everything would be ok, the lawyer guide us if I hire her so that I don’t really understand the process or what information you need to help me.

 

I entered to the us with a student visa last August.

I got married with an American citizen in November.

I hired a lawyer and am giving her information she asked.

The visa will be expired in February.

 

My husband started working from last April. 

April to December he made about $20000.

(He didn’t make enough in 2018 too since he was traveling.)

 

The lawyer said he is not qualified to be my sponsor and told us to find a joint sponsor but we couldn’t find any.

 

i already took a health check when someone said yes to be a sponsor but he changed his mind. Im trying to apply before this will be expired at the end of Jan 

 

He doesn’t have IRS tax return for this year and we can’t wait until he get it. Is it ok?

Best bet would be to get your husband to joining and both of you get more involved in the process, you do not need a lawyer, well most likely, you do need to understand the process and it seems your Lawyer may bot be helping matters.

 

Start by reading the I 864, seems your husband is fine to sponsor on basis of income.

If you project out your husband's 2019 income for 12 months it does exceed the I-864p "minimum" level.   Better yet take his last months earnings and multiply them by 12 and use that number.

If you had said that at the beginning (or even better, filled out a timeline), you would have gotten better answers and not caused folks to waste their time approaching this as a visa interview.

Read up about the whole process, think of it is a study assignment, it is not that complicated. You are here to study so well withing your capabilities.

~~moved from IR1/CR1 process and procedures to AOS from student, work, and tourist visas.  OP is adjusting status, not applying for a visa~~
