Hello All,

My Fiance lives in Italy. But he is not an Italian citizen. Right now he has claimed Asylum because he had to flee his country (Nigeria) from abuse. He is allowed to work in Italy and he is waiting for his papers to become a legal citizen in Italy. However, I am an American and would like him to come to the US to live. I dont know the first step to get him here. We are getting married in Italy in July. Can someone give me some advice please.

It is best to start with the family based visa guides.  Since you are planning to get married in Italy in July you would most likely be interested in a spousal visa.  Btw, lots of folks file for persons not living in their country of citizenship.  As long as he is legally living in Italy you should have no issues.

Good Luck!

Well you can start and then delay at thr NVC.  This is the easier route.  You can slow down but you cant speed up. I would send the I-130 now.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Highly suggest you read the guides so you understand the process. :) the I-130 petition is just the start but it is the part you have the least control over after it's sent.

Have you met?

Seem to recollect a very similar case a bout a year ago?

Marriage would seem the better option in a case like this.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Of course, they have to get married before the I-130 can be filed -- unless they apply for a fiance visa.
