Change from Spouse Visa to Widow Visa

Hello Everyone,

 

I just lost my husband while our case still at NVC. I send an email to ncv tru AskNVC form and I informed them about the death of my husband and attached the death certificate last Dec15,2019.

 

Does one email is enough? I mean no need to call them to follow up?.

Sorry for your loss but i believe the petition is no longer valid with your spouse’s death and so they will not issue an immigrant visa and there is no change from spousal visa to widow visa. Only in few humanitarian cases, they may issue visa that too after one first contacts the USCIS service center that approved the i130 to have the petition reinstated. 
 

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

I posted in some other groups and most of them are saying that the approved I-130 will be converted to I-360 which is for widow visa. My case is very rare actually. I have my case number already and upon checking, my case is still at NVC under CR1 category. not sure what they will do with my case. either converting to widow visa or to be returned to uscis for reinstatement.

In that case i suggest you contact USCIS as well and update them about your spouse’s death while you wait for the response from NVC as they may take a while to respond. I am not sure if NVC processes that by itself without having the petition updated by USCIS. Good luck.

Thank you... i might call them asap to inform. I was confused as others are saying it will be now the nvc's role to convert it to new category since my case is still with them.
