Well we do not know what they know, this is for a friend.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

So all useless speculation then seeing as friend is asking on their behalf without knowing what they know?

Well them heading out voluntarily seems unbelievably unlikely.

So then their options are :

1) stay illegal forever

2) risk getting deported and further complicating any ban they already face

There, now it’s simple.

Hi everyone, I'm trying to help a good friend of mine, his parents came to the USA from Mexico illegally , his mom gave birth to him and then got back to mexico to give birth to his brother in Mexico,  again they decided to get back to the USA, his parents or brother has no docs , he's trying to help so bad cuz his bro wanna go to college and get a decent job as everyone , I would love If someone could help him even by advice thank you.

Unfortunately, they aren't the first and won't be the last family to do something like this. The crappy part of it all is when they actually try to do the right thing and then realize how much they've set themselves back. Maybe they need to consult an immigration attorney who will - more likely - give them the same info that they got from the members on VJ but at a cost.

1 would be a breach of the VJ ToS.

They don’t have to live here illegally - they can go back home to Mexico. Assuming the USC son is old enough, he can sponsor them and they can then move here legally when their bans are over.

The parents may have a permanent ban. Coming in illegally, staying for over a year, leaving and coming back causes a permanent ban. I don’t know if it was for over a year the first time, though.

It wasn't a recommendation, just an observation, admittedly one already made a couple of times by another poster earlier in the thread. You dismissed the legal option i gave, so the observation was that that was all that was left.

Here are the issues:

1 Your friend as a USC can petition for his parents as an immediate relative. Because they entered illegally, they will have to leave the country for their interview. Once they leave the country they will have a 10 year ban for overstay.

2. The brother has the same issues, except he is not an immediate relative. That means he has to wait until his preference category becomes current, which for siblings is about 20 years.

3. The brother can marry a US citizen but will still need to leave the US. He may be able to get a hardship waiver, but it’s difficult.
