Hi everyone, I'm trying to help a good friend of mine, his parents came to the USA from Mexico illegally , his mom gave birth to him and then got back to mexico to give birth to his brother in Mexico,  again they decided to get back to the USA, his parents or brother has no docs , he's trying to help so bad cuz his bro wanna go to college and get a decent job as everyone , I would love If someone could help him even by advice thank you.

there is nothing he can do for them, it was their decision to stay and live illegally In the country. if they would have stayed in Mexico, they would have had a chance. now they will have to live here illegally unless the laws change. Now, there are colleges that accept undocumented people. Did his brother ever qualify for DACA? your post doesn't say how long his brother has been living here.

 

for his parents there is nothing he can do for them, they will have to live here undocumented like millions of others are.

They don’t have to live here illegally - they can go back home to Mexico. Assuming the USC son is old enough, he can sponsor them and they can then move here legally when their bans are over.

of course, but petitions for Mexican siblings take over 20 years, and if the parents leave they would have a 10 year ban. all of them have a 10 year ban. Her friend is asking if there is something he can do for them while they are here. all can leave, but his brother wouldn't be able to go to school currently in the US

Yes the guy depressed and blame his parents for this , he said he can go to college but he can't get an official job , his family and bro been here for 21 years, they wanna go back to mexico and start the process but I know its gonna take forever so I told him to let me ask first .

They said they can leave to Mexico and start the process but I'm sure it will take forever

so first his parents would have to wait 10 years out of the country before even being able to be petitioned by your friend. your friend can file for his brother once they are back in Mexico, but the wait is 20 or more years. He could even file for his brother now, assuming he is 21 or older, but his brother would have to leave for the 10 year ban

 

there is no waiver for parents or siblings. 

 

Now, if they have been living here for that long, why didn't his brother apply for DACA if he came here under 16 years of age?

If they want to be legal they have no other choice, unfortunately bad decisions have consequences. They will have a 10 year ban. He can apply for all of them, the wait for the brother will be longer but not much they can do about that.

Well pity they didn’t start this whole process a decade or two back, then they’d be here legally by now.

Wonder how the brother is planning to fund college, I know some states give instate tuition to undocumented, but they are not eligible for fafsa funding as illegal. Assuming brother’s spanish is fluent, college in Mexico is an option.

This is what I would do. Have them go back to Mexico, the USC child petitions for all of them, and assuming all goes well in 10 years, the parents get their GCs and then they come over and also petition for the other son.  I am not sure which petition for the other son/brother would become current first, but that brother would be long past his 10 yr ban.

both of them are over 20 years, whether the sibling files for him or his parents file for him as he will be over 21. so it would be best if the sibling filed for him now so the clock starts ticking. then all leave now

 

after 10 years he can file for parents, and after 20 years, his brother can get his GC. and the 10 year ban will have passed,

Most states they can go, the question is whether they can get funding too. Generally not easy for an illegal family to pay college tuition all cash.

I don't think they know about that I will tell them about that I'm not sure what they will do tbh

My understanding is that if the son doesn’t already have DACA he can’t apply now, I believe only renewals are currently being accepted? Someone correct me if this is wrong.

 

Gotta say I find this all a bit strange that they don’t know about it living here, I knew about DACA when I lived on the other side of the world and long before I started the immigration process. I’m assuming he doesn’t actually have it or he would be able to work legally already... if my understanding is correct,
