Filing 2018 taxes by paper

I need to file my 2018 taxes because I'm doing the US spouse visa. I did my 2017 taxes, but 2018 is different, so I got confuse. Also, I'm not residing in the United States and I havent lived in the United States for 3 years.

 

Question 1: So I'm guessing I don't need f2555ez and f8965 for my 2018 taxes?

 

Question 2: My wife doesn't have a visa, nor a social security number. So I'm guessing I put married filling separately, and I don't put her name?

 

Question 3: My son is a US citizen, but he doesn't have a social security number. So I guessing I put "Not a resident"? Also, I'm guessing I don't check any of the tax credits on the right hand side.

Question 4: I attached an image, but I don't know where else to put numbers. In my 2017 taxes, I was able to put my f2555ez information to deduct the taxes amount owed to $0.

This is more of a tax preparer question than here.  Note that NVC cares for your income and if you filed taxes. I dont think they give a hoot if it is accurate, taht's IRS job.

Treat you filing your taxes as normal. If you were outside USA and not required to have health insurance coverage, those forms may still be relevant in 2018. Again, as a tax professional.

Why not apply for an ITIN for your immigrant family members and make this simplified?

You get to file your taxes as MFJ or HoH and get a lot more in return, almost twice if eligible...

Applying ITIN is easy and straightforward. Infact you can combine the ITIN and tax return but you will have to mail in the application.

 

Fill form W7 and put it on top of her Form 1040 or Tax Return and mail it in.

You can also put a simple declaration like this as a cover letter.

Once they come here and get an SSN, then simply send a copy of the ITIN letter that had the number and tell IRS to update it with your new SSN (instructions in the letter when you get the ITIN).

Income tax got a big overhaul in 2018. New forms. They have a manual on IRS.gov called: 2018 form 1040 instructions . Find it. Use it. The Schedule 1 instructions are toward the end. You need Schedule 1

Yes you need form 2555EZ or you will owe US tax on your earnings. Here's a little assistance, but use the instructions for each form. If three pics don't upload, I will add a post.

And yes file MFS.  You can't improve owing ZERO by filing jointly.

Put her name where it asks for spouse. Her SSN is NRA or "nonresident alien"

From my research, it seems like there is no consecqunces for me doing my taxes late because I don't owe any taxes, but can anyone confirm this?

 

 My son is a US citizen, but he doesn't have a social security. Does anyone know how long it will take to get a social security?

Do you see where I put parentheses around the 24,103 in Schedule 1 and Form 1040? That is how the instructions say to indicate a negative number. You need minus $24,103 in those places indicated by ($24,103). Otherwise the correct math would add an additional 24,103 instead of subtracting it. 

 

And yes, your maximum exclusion is correct for 2018 at $103,900. I put the new 2019 amount. Sorry. 

 

Form 1040 in your original post needs your wife's name on that very first line where you put your filing status of married Filing Separately . There is a gray area at the end of the line where you write in her name and NRA. 

 

Form 2555EZ needs:

3. Tax home YES ticked

9b. Foreign employer

10a. Didn't you say you filed an income exclusion before? Put year.

10c. Tick No

12. Did you have any visits to US in 2018? List dates. 

 

No late consequence except if you owe money. They tack on interest for what you owe. 

I would leave the child's SSN blank. He doesn't qualify for the credits and that's the only reason he needs a SSN.

Wuozopo, thank you again for your time and help.

 

I didn't think about asking this until now, but do I need to attach some sort of proof of the income that I had? For example, in the US, there is the W2 form, but in Korea, we don't have a W2 form. My only proof as of now is the private school putting money in my bank account. To the best of my knowledge, I didn't send any tax income info to the IRS for my 2017 taxes and the IRS didn't say anything about it.

 

Also, for my f8965, I didn't add my wife and my child's info because I'm guessing it doesn't relate to them.

No proof of foreign income is included with the return. BUT you should prepare something to file away with your records (bank statement showing monthly income) just so you have it in case you were audited. It will remind you where you came up with the figure you reported.

From reading the 1040 instructions, I believe the insurance checkbox on the Form 1040 is for you to check about yourself and anybody else on the return (your son). You posted photos of it both ways--checked and not checked. Not sure which you considered final.

 

if doing the Form 8965, I also believe your son has to be listed because he is named on your return as a dependent. Your wife is not filing on this MFS return so would not be listed.

 

But the instructions indicate that if you check the box on f1040, then you don't have to do f8965. That form is to calculate any shared responsibility payments you might owe if you had some months not covered and not exempt. You and listed dependent are exempt for the full year. 

Purpose of Form 8965

The individual shared responsibility provision requires each individual to have health care coverage, have a health coverage exemption, or make a shared responsibility payment with their tax return. If you can't check the "Full-year health care coverage or exempt" box on page 1 of Form 1040, use these instructions to figure your shared responsibility payment if for any month you or another member of your tax household (defined later) had neither health care coverage nor a coverage exemption. If you can claim any part-year exemptions for specific members of your tax household, use Form 8965. This will reduce the amount of your shared responsibility payment.

Checkbox on Form 1040.

 

The "Full-year coverage" checkbox that was on line 61 of the 2017 Form 1040 has been moved to page 1 of the 2018 Form 1040 and retitled "Full-year health care coverage or exempt." You will now check that box if you, your spouse (if filing jointly), and anyone you can or do claim as a dependent had qualifying health care coverage or a coverage exemption that covered all of 2018 or a combination of qualifying health care coverage and coverage exemptions for every month of 2018. If you can check the box on Form 1040, you don’t need to file Form 8965.

 

Also did you remember the parentheses for negative number here?

The one I was going to send was the one without it checked, but after reading what you wrote, I'll send the one that is checked.

I just noticed when you added your wife's name where it belongs in the blank area on the Filing Status line, you also added her name on the line below your name. That line says says:

 

"If joint return, spouse's first name and initial ..Last name .. SSN"

 

It's not a joint return. That entire line should be blank.

Thank you for noticing that mistake. I was wondering about that,because it didn't make sense for me to put it there.
