My son, an Indian citizen who is on an F1 visa , has just graduated (Dec 2019) with a bachelor’s degree in the STEM stream. He has also obtained his EAD for the OPT with the work authorization beginning in Feb 2020 (and valid till Feb 2021), and he has accepted a job offer from a company in Silicon Valley. His F1 visa is valid till Jun 2020.

(1)    He plans on making a short visit to India in Jan 2020 before starting on his job in Feb. Will he face any issues on the visa front while reentering the US after his trip?

(2)    Can he renew his visa while he is in India even though he has until June before it expires?

(3)    If the answer to Q(2) is a ‘No’, can he continue to stay in the US beyond his visa expiry date until the EAD expiry date (in Feb 2021) provided he is still employed? When is the latest by which he should get the visa renewed?

(4)    While I understand that the visa renewal period is at the discretion of the USCIS, is the validity typically for the remainder period on the EAD i.e. will my son’s F1 visa  be renewed only till Feb 2021?
