Newly Married K-1 Visa in USA, Forms order now?

Timeline

Hello! I just married my K-1 Visa Fiancé on 12/18/19.  I know we need to do follow on forms to get her green card, work AUTH, SSN, etc.  I just don't know what order is the best to submit them.  Plus, any recommendations on (besides an attny, cant afford an attny and fees) to check my forms?  Don't want to submit the forms and something be wrong and have to pay again.  She's traveling back home (Manila) in April 2020 to get the kids prepped to come over(I'll follow on 2 weeks later). 

 

I know the following forms are required just don't know what order and if I can pay to file them together.

 

1. 485

2. 765

3. 130/130A

4. 864

5. ?????

SSN is the first thing you get when you enter.

 

Travelling home in April?  Not sure how that is practical as you seem to want to through the adjustment process.

I highly suggest you study the K-1 applicable immigration guides of this web site.  It will answer your questions.  Her traveling out of the US in April 2020 is doubtful as she will need an approved I-131 to re-enter the US without abandoning her Adjustment of Status.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

As reported by other VJ members, the average time for approval of an I-131 Advance Parole document is about 5 months. Leaving the US prior to receiving this approval will result in abandonment of her Adjustment of Status (I-485).

You don't file I-130 if you're K1. You're probably thinking about I-131, which is Advance Parole.

Just one fee for the I-485. 131 and 765 are free when filing along with AOS

 

The best thing you can is research. There's a lot of guides here with all the forms and evidences you need.

 

Like already said before. I doubt she's gonna have her combo card before April, and she can't travel outside the US without it.

She can travel, the problem is getting back to the US

Doing a K2 follow to join needs to be planned very well from the very beginning.

 

Once you have the certified copy of the marriage certificate you can file the AOS packet and the AP and EAD.  File a G-1145 with them to get notifications.   After you get the NOA for the I-131 you can ask for an expedite. It is more common to get expedited based on the need to work.  Don't hold your breath.

 

You should have filed for a SSN before getting married.  Now you wait until getting the EAD.

 

She can not leave the US until she has the AP or Combo Card.  Otherwise you will do the spousal visa process.

 

The kids' visas have to be done prior to the one year anniversary of the issuance of her visa.

 

When was her visa issued?

March 2, 2018  Married In Hong Kong

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed

It's better to say they can leave but can't return without a new visa, as that is actually correct.

These are the forms to file.  The fee that you pay is the fee with I-485 (adjustment of status, the application for the actual green card) only.  
If filed together EAD (I-765, employment) and the advance parole (I-131, allows travel while waiting for greencard) do not require fees.

The I-864 is the support affidavit.  No fee.

 

 

If she leaves the country before the I-131 (advance parole) is approved she will not be able to return until you file an I-130 petition, wait for approval, go through NVC processing again, new medical, new police certificate, new interview, and obtain a CR1 or IR1 visa.
