JANUARY 2020 K-1 NOA2 to NVC to EMBASSY

Timeline

I have a question on this part of the I-134 form, I have filed in the past a previous K1 Visa that it was approved but then I withdraw a couple of years ago at embassy level. DO I HAVE TO DISCLOSE THAT INFORMATION HERE? regardless if I canceled it?

The key word is FILED. Not approved or completed. So has anyone ever FILED for you besides your current petitioner (in this case,  you = beneficiary). If so YES, if not NO. Most answer it NO as they have never had a case FILED for them prior to their current petitioner.

 

The DS-160 is about the beneficiary. The petitioner can help but all the information asked for is from the beneficiary.

I think they are refering to the I-134 Affadavit of Support and my understanding is that the petitioner must list both their current fiance/beneficiary but also anyone else they have filed a visa application on behalf of in the past.  (At least that is what I see on the VJ example form.)

Hello @Greenbaum, I am the petitioner, filling out the I-134 form. I am a bit confused with your answer, I apologized for not clarifying. as the petitioner filling out that form, I had filed a previous I-129F which it was approved but then I withdraw the application. so I do not know if I should list that application even tho it was canceled.

Yes!! I am referring to the I-134 affidavit of support, I did filed a visa petition a K1 for my Ex a couple of years ago but I withdraw the application when it got to the embassy. Now I am in a new relationship and filed this K1 and we were approved and getting all the documents for the interview so I was not sure I should list that K1 I did three years ago.

You maybe right. I assumed they were talking about the DS-160 as it is the same line number and question. We'll see if the OP can clarify his or her answer.

After reviewing the question from the form my answer would be yes. You filed a petition. It doesn't ask if it was approved, removed, canceled or abandon so "yes" would be my answer. They will use your answer to further investigate that petition. They will be looking for whether that person arrived in the states, "married" and living here with or without your support. Since they never came you are in the clear. You see you're obligated to support that person for 10 years or to USC status. If you are still supporting that person, or should be, then that person becomes part of the equation to how many dependents you are supporting for this petition.

Hello all - 

I see we need to submit passport size photos for the beneficiary for three processes during this phase - 

1) DS 160 (uploaded)

2) medical exam (bring)

3) visa interview (bring)

 

Does this need to be the same photo for all three processes? The reason I ask is I'd like to take the uploaded DS-160 at home and worry about the others later when it's actually time.

No they do not need to be the same to use for all the upcoming requirements. The only two requirements are that they are not older then 6 months and that the meet the photo requirements as outlined from the link below.
