Marriage won’t solve the issue of proving that either one of them is not married. What specifically did the embassy request from you? Doesn’t sound like you provided what they asked for but provided what you thought was sufficient. A copy of the guy’s marriage certificate does not prove dissolution of marriage. It just proves that he married someone else. And what worked for one embassy may not work for another. They’re not questioning how much time you spent together. It sounds like they’re questioning whether she’s free to marry, which is why they say she’s ineligible. But sounds like you have it figured out, so go ahead and get married.

The documentation you submitted was obviously not sufficient or the K-1 would have been approved.  If you get married and file for a CR-1 they will have the same "suspicions" as with the K-1 application, and if you submit the same documentation, the result will be the same, a denial.  The only difference this time will be that you can file an appeal which takes a year or longer, you may need to hire an attorney experienced with waivers for lying on US visa applications.  The road will be long and expensive, with no guarantee of success in the end.  Be prepared to live in the DR with her if you want to be together.
