Oops you are a USC so does not matter who sponsors, still remains the same with a future spouse.

When he brought the idea to his Nana and I we both informed him that he was too young to be getting married but they are both insistent on getting married.

For the Dec 2019 and projected for Jan 2020 states that F2A is current. Am I wrong in thinking that means a visa is immediately available? He would not be applying from the USA. I would apply for him and he would attend the US Consulate in Montreal for an interview abroad. So it would be more like them being apart for a year to a year and a half correct?

So, 3 things:

1. F2A is current now, but likely won’t remain so for much longer;

2. The petition still has to be processed and approved before a visa interview can take place, which is where the 2 or so years comes in;

3. He can’t apply for her until he has his own green card in hand. So the time he spends waiting for his own green card, yes he will be with her but it doesn’t reduce any of the time she will subsequently spend waiting for her own.

Technically, both can submit I-130 petitions as an "insurance policy" (death of petitioner, etc.) to avoid time lost (i.e. filing the other I-130 after original petitioner's death). But, IR-2 timeline is relatively short that odds are the "insurance policy" won't be used.

Good Evening All,

I just acquired US Citizenship this past July 2019. My son is thinking of getting married August 2020 but I have been thinking lately about his options to immigrate to the USA. I wanted to post here before talking to my wife and him about these options.

IR-2 Route (If him/his fiancee are willing to post pone the wedding😞

1. Can he immigrate as the recipient of an IR-2 visa while being engaged?

2. Can he get married shortly after immigrating to the USA?

3. Back in May 2019 he had some mental health issues where he self-harmed, he is currently on medication and has not self-harmed since, will this be an issue?

4. Will he be allowed to immigrate to the USA at 18 years old?

If he got married then he would have to go the F-3 route which would take 12 years or longer from the PD.

If anybody has any other options they would be greatly appreciated.

That is really the big question now.  If they are not willing to postpone for 12-24 months, then the options are more limited.

Good Luck!

I'm sorry if I explained this wrong, but his Nana is not doing well. She is not a USC nor in the USA.

Anybody in your situation really should have sponsored earlier.  If he landed before 18 he would be automatically US citizen wouldn't he?

We asked him when he was 13 or 14 and he didn't want to live with my wife and I at the time. I thought the same thing, that he shot himself in the foot, cause yes if he would have immigrated sooner he would be a US citizen, but have remember that he made a decision to not live with us at that time. I had done everything that I needed to do so as to have him immigrate; traveled back and forth to Canada to get custody as his Nana had custody and was willing to have him live with us. A few weeks before I got the order to take action on the case he decided that he did not want to live with us.
