Visa Options For My Son

Good Evening All,

 

I just acquired US Citizenship this past July 2019. My son is thinking of getting married August 2020 but I have been thinking lately about his options to immigrate to the USA. I wanted to post here before talking to my wife and him about these options.

 

IR-2 Route (If him/his fiancee are willing to post pone the wedding):

1. Can he immigrate as the recipient of an IR-2 visa while being engaged?

2. Can he get married shortly after immigrating to the USA?

3. Back in May 2019 he had some mental health issues where he self-harmed, he is currently on medication and has not self-harmed since, will this be an issue? 

4. Will he be allowed to immigrate to the USA at 18 years old?

 

If he got married then he would have to go the F-3 route which would take 12 years or longer from the PD. 

 

If anybody has any other options they would be greatly appreciated.

If he's under 21 and unmarried then yes

 

2. Can he get married shortly after immigrating to the USA?

Sure why not as long as he is of age. He will not be able to bring his fiancee over initially. He would have immigrate and get his GC then they will have to get married and then he will have to sponsor them for an F2A

 

3. Back in May 2019 he had some mental health issues where he self-harmed, he is currently on medication and has not self-harmed since, will this be an issue? 

Self harming so recently could have an impact on the petition. It will be up to the panel physician to make the call. Based on the CDC guidelines if the physician suspects the patient is current self harming or may in the future it could cause them to classify the person as Class A which makes them inadmissible

4. Will he be allowed to immigrate to the USA at 18 years old?

People of all ages immigrate to the US. Do you have a specific concern?

 

If he got married then he would have to go the F-3 route which would take 12 years or longer from the PD. 

 

If anybody has any other options they would be greatly appreciated.

Thank you design guy,

 

My whole reason for bringing this up is because his Nana is ill and has stopped meeting with medical doctors as she feels like a guinea pig. I feel that after his Nana passes away, not that she is terminally ill, but when she does he will have very little support. I also work in the mental health field so I could even personally help him. Do you think that if the I wrote the panel physician a letter stating that he would continue to meet with a psychiatrist/therapist after immigration that may help?

I don't think so. He will need a letter frim his doctor explaining his situation (diagnosis,  time of treatment,  etc...)

I was in treatment for Anxiety disorder and I needed to present a loooot of papers. 

You are the sponsor and his mom, so they will not take your letter to well (in my opinion).

He will have a wife.

He's going to be turning 18 years old May 2020. Hypothetically he will be an adult and hopefully no court custody documents needed for him to immigrate.

He does not have a wife at the moment. I wanted to get some options so that I can present them to him and see if his fiancee and himself want to put off the wedding so that he can immigrate and then go through the process for her once he is able. What I was saying is that I have to talk to my wife about the situation so I wanted to get options. He is currently engaged.

Unusual these days for a 17yo to be looking at marriage already, already engaged. Wow.

and yes, no custody documents will be needed for an 18yo.

Do he and his fiancée understand that they will be apart for probably 2-2.5 years before she can join him as a spouse if he immigrates first?

Presumably you’ll be co-sponsoring the wife to be as well.

I was thinking longer, but exactly how long is an unknown.

When he brought the idea to his Nana and I we both informed him that he was too young to be getting married but they are both insistent on getting married.

For the Dec 2019 and projected for Jan 2020 states that F2A is current. Am I wrong in thinking that means a visa is immediately available? He would not be applying from the USA. I would apply for him and he would attend the US Consulate in Montreal for an interview abroad. So it would be more like them being apart for a year to a year and a half correct?

Well your spouse has to sponsor him and then he would have to marry and sponsor her, what the F2a will be at that point is unknown, not reasonable to assume it would be current.
