Hey all, I hope you are all doing well and having a better day than me. I was here last time concerned about my siblings being denied visa based on the new public charge and health law. My mom is the petitioner for her minor kids, after approval USCIS we submitted civil documents and financial papers. She filed form I-864 and I filed I-864A. she makes $7000 a year and I make $59000. both incomes combined come to $63000 for an household of 6 members. So today the embassy requested my mom to complete and submit form I-864EZ and W-2 form which totally excludes me from the process and they will base on her own income. Which is not even close to the $38000 required by the poverty guidelines for 5 persons. I don't know if anyone has been in this situation before or have any advises please share your experience. I'm completely lost.

Well I would assume the next step would be a RFE for a Joint Sponsor,  you say plural, how many may be a factor.

It was only my mom and I. We don't have anybody else. We started the process knowing that since she won't qualify based on her only income, I will be the co-sponsor, given that I made $59000 last year. So she submitted the form I-864 as primary sponsor and me form I-form I-864A as household member. it is still marked as accepted in ceac. Now they marked form I-864EZ and W-2 as missing.

They asked my mom to submit that to the embassy before they can make a final decision.

You mentioned siblings so I assume several are being sponsored, did each one get the same request?

If you are the co-sponsor, don’t you also have to fill out your own I864?

No, I only had to file I-864A as household member, and they accepted that. Now they didn't asked anything else about me. They are only asking my mom to provide form I-864EZ and W-2 that doesn't allow anyone else to Co-sponsor.

Well we can guess but I do not think there is anyway of knowing, can not think there is anything you can do now, well to be precises I do not know anything that can be done now, sounds like a wait and see,

My understanding is that the OP submitted the documentation showing her as a joint sponsor and is now concerned that the Consulate will in this case not accept a joint sponsor.

I put myself as household member. I filed form I-864A and she filed I-864 before the interview. Now the form I-864EZ plus W-2 are marked as missing in the ceac account.

Well NVC does make mistakes. Call NVC and request to speak to a Supervisor to get it all straighten out. She can;t use I864ez as yuo stated since she has a joint sponsor.

 

6 people with a combine income of $59,000 and you are the son. Don't be surprised if the embassy asked for a new joint sponsor. Seems you need better income. Because what happens if you leave the home get married have kids Your mom only makes like 2 months salary a year that won't sustain a family of 5 with you gone and they will see that. Immigration is looking long term at the 10 year commitment, not just what they make now.

 

Call NVC straighten it out and get a backup plan.

Combined incomes $63,000. How is realistic to show a prediction of 10-years steady income? 
I called NVC they said they already forwarded the files to the embassy, that I can only deal with the embassy now.
