Timeline

Hello - new here. I am going to file the fiancé visa application soon. I have some questions..(1). is it necessary to hire a lawyer or pretty self explanatory to do this yourself? 

(2) I met my fiancé few months ago in person but due to short time and being super busy we got no pictures together. I also don’t have my boarding pass anymore. Is the booking confirmation, passport stamps, texts, love letters proof enough? FaceTime screenshots? Any other suggestions? I don’t want my application to be denied because we have no photos.

It's fairly easy to do yourself as long as you follow the instructions. Make sure you gather all information needed. For the I-129f, you don't need proof of a relationship, rather proof that you have met within int past two years. 

 

Submit whatever evidence you have to show that you met.. Were in the same place together at the same time. They don't want "love letters".

Hi, if you do not have problems with the law in your our another country not is necessary hire a imigration lawyer,but you can find some company that working helping people with  your visa process they help you with all your doubts,documents,the step by step,etc. I personally hire one and its help us a lot! About the pictures will be too much better if you and your fiancee had many pics together,remember you have to prove your relationship is real,so all the proofs of it is better,you can also consulte a imigration lawyer to help you with those questions (not hire one but pay for one consulte) or maybe if is possible your fiancee could you visit you again and we took pictures together. I hope I could help you. ;)

You have come to the right place to do your own visa. Their are guides (see the blue ribbon, find "guides" and select that and on the page look for the instructions for the K-1 visa. Follow it and if you have questions, you now know what to do because you are already here asking.

 

Here is a quick list of what is needed. Match what you have with the list. If USCIS wants more evidence after you submit your application package, they will send you and RFE (Request Further Evidence) which you will produce the requested documents and return per the instructions. Simple.

 

  1. Evidence of ongoing communication with the petitioner, including, for example, emails, letters, phone/video call records, and text/chat/messenger transcripts from throughout your courtship.
  2. Photographs of you and the petitioner throughout your courtship.
  3. Evidence of all times you and/or the petitioner have traveled to see one another, including photos, tickets, boarding passes, hotel reservations, etc.
  4. Evidence of any shared finances, including money transfers, shared accounts, or joint assets.
  5. Evidence that you have made plans for a wedding in the U.S., including evidence such as a reservation with an officiant or court, printed wedding invitations, a list of vendors and their contact information, receipts for wedding outfits, rings, etc.
  6. List of planned wedding guests, their relationships to you, and their addresses and phone numbers.
  7. Notarized statements from both petitioner and beneficiary describing and detailing how you met each other and why you decided to get married.

The I-129F is straightforward to complete, even if you hire someone YOU will still have to provide all the info, "they" will basically be completing the form for you, and YOU will still have to verify "they" entered the information correctly.     Follow the I-129F instructions (read them more than once  ;)  )

 

USCIS does not want ongoing relationship evidence.  USCIS for the I-129F want evidence of having MET IN PERSON within the past 2 years.   Photos are secondary evidence.  

 

You will have to make do with the evidence you have.  Passport stamps are good.  Boarding passes would have been good.   Any receipts from while there?

As others have said, a lawyer isn't necessary unless there are problems like criminal convictions or visa overstays by the beneficiary. The process is mostly about compiling evidence and documents, and a lawyer can't help much with that. The form filling once you have the documents and information isn't too difficult.

 

Which country is the beneficiary from? In theory all k1s are treated the same, but in reality you'll need more convincing evidence if beneficiary from certain countries. Typically things are easier if you are coming from a richer, developed country (eg EU, Australia, Japan) than a less developed or poorer country. There is more incentive for someone from a poorer country to marry for a visa, than someone who already lives in a richer developed country.

 

At this stage you don't need to prove a relationship, but you have to prove that you've met in person at some point within the past 2 years. The lack of a photograph together might be an issue. Photographs don't prove WHEN you met but they do prove that you HAVE met. Boarding passes and passport stamps help prove WHEN. So a combination of various types of proofs are what you are looking for. In these days of smart phones I'd find it curious that a couple didn't have one single photograph together. I think USCIS might consider this curious too. I've been married to my wife for nearly 5 years, and we still take selfies together when we visit places!
