Lawyers... do I need one?

Hi there

I am new to the forum, though I have perused the site quite a bit. I am a US citizen living in Brazil with my fiance (husband, as of next week). I think that we will be applying for a CR-1 visa, but I am getting all of the information together before we get started (and, after the wedding, obviously).

If any of you would be so kind, I have a few questions...

* Do I really need a lawyer, or do you think I can get away with minimal legal assistance?

*Also, does anyone have an opinion on whether it is more or less difficult to get a K-3 versus a CR-1?

*What are realistic timelines for acquiring a K-3 or a CR-1 visa?

USCIS

August 16, 2007: Filed 1-130 at VSC for CR-1 Visa

December 21, 2007: NOA1 issued (I-130 now at CSC)

February 27, 2008: NOA2 issued

NVC

March 07, 2008: NVC case # received

March 26, 2008: Fee bills arrive

April 01, 2008: Fee bills paid

April 11, 2008: NVC processes fee bill payments

April 24, 2008: AOS and DS-230 requests arrive from NVC

May 13, 2008: Completed AOS and DS-230 packages sent to NVC

May 23, 2008: RFE for Police Certificate (even though all original docs were sent!)

June 30, 2008: Checklist Letter Response received at NVC (new documents)

July 8, 2008: Case complete

July 16, 2008: Case forwarded to Consulate

US CONSULATE - RIO DE JANEIRO

July 22, 2008: Case arrives at Consulate

July 24, 2008: Medical Exam

August 14, 2008: INTERVIEW! Visa issued!

August 18, 2008: Received immigrant visa and document package via DHL

January 16, 2009: Enter US at LAX POE

1-751 JOINT PETITION

November 5, 2010: Mailed file for 1-751 Removal of Conditions

November 6, 2010: Petition package arrival at CSC [check cashed on 11/10/10]

November 12, 2010: NOA1 received

December 14, 2010: Biometrics appointment

February 11, 2011: Approval of Removal of Conditions

We did not use a lawyer for any part of the process so far, our situation was simple, no divorces for either of us.

As for easier, K-3 is slightly less of a problem, affidavit of support used at the visa interview is the I-134, and in some situations, CR-1 uses I-864, and the petitioner needs to present one for interview, and if petitioner has been living out of country for a while they can have problems with the USA domicile, and IRS return requirements of the I-864.

as for timeilines, VJ has a timeline section, just select visa type, and filter for country, and service center that you will be dealing with.

You can peruse timelines here and filter by Brazil if you want an idea. You should also determine whether you qualify to file directly with a Consulate in Brazil for the CR1 visa. If so, that would be your fastest and best bet.
