Hi! My fiancé is Venezuelan and living in Chile. We had thought about going the K1 route but with have decided to get married the next time I am in Chile (I am a US citizen living in NY) and start the spousal visa process. It just seems to be a better option even with the longer wait. Does anyone have an indication of how long the process is taking from Chile? I feel like it is such a long range of time depending on the country.  Thanks!

It's the same everywhere. You first get married, then file the I-130. It'll take USCIS 8-12 months to approve the I-130, then it's sent off to the NVC. It'll be 2-5 months at the NVC before an interview can be scheduled. All spousal immigration petitions follow the same route, except in limited circumstances.

I don't think so. Some countries have longer wait time to get an interview appointments just due to number of people, that's the only difference.

I don't think so. Some countries have longer wait time to get an interview appointments just due to number of people, that's the only difference.

Attorneys are telling me it’s taking 5-8 months for the USCIS - any reason why?

Probably have outdated data and haven't bothered to recheck themselves. You'd be surprised how many lawyers are out there that don't give or know correct immigration information, people on here have lawyers mess up all the time sadly. Typical processing time these days is around 6 (approaching 7) months for Potomac service center (but chances of getting Potomac is extremely lucky), 8-10 for Texas service center, and 12-15.5 (but most commonly 12-13) months for Nebraska. Anything sooner would be by expedite, which is fairly hard to get at USCIS stage unless you can prove you have an extenuating circumstance. Most people seem to get either Texas or Nebraska so 8-12 months like USS_Voyager said is pretty much the average. And where you get assigned is basically random, so you don't know what service center you will get till you get there pretty much

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!
