Dear guys

My name is *** I ve been in USA in Pittsburgh, PA for 3 weeks by b1/b2 visa , two days ago I had been attacked and rubbed by 3 men ,they got my car key cash pocket, hit me several times by a gun . I called Police and they got the records and the hospital medical reports .

May I apply for U visa (as a victim crime person)

You can apply for it but the chances of you actually getting it are slim to none. Look at the requirements. It'd be a stretch to try to prove all of them in your case. Each year, 10,000 visas are offered to principal applicants, but the demand for visas is significantly higher, which has led to a backlog that now stands around 142,000 applications (Niskanen Center, 2019).

The crime would have to fit the list of qualifying criminal acts:

 

Abduction Abusive Sexual Contact Blackmail Domestic Violence Extortion False Imprisonment Female Genital Mutilation Felonious Assault Fraud in Foreign Labor Contracting Hostage Incest

Involuntary Servitude Kidnapping Manslaughter Murder Obstruction of Justice Peonage Perjury Prostitution Rape Sexual Assault Sexual Exploitation

Slave Trade Stalking Torture Trafficking Witness Tampering Unlawful Criminal Restraint Other Related Crimes

 

AND:

 

• You have suffered substantial physical or mental abuse as a result of having been a victim of criminal activity.
• You have information about the criminal activity. If you are under the age of 16 or unable to provide information due to a disability, a parent, guardian, or next friend may possess the information about the crime on your behalf (see glossary for definition of ‘next friend’).
• You were helpful, are helpful, or are likely to be helpful to law enforcement in the investigation or prosecution of the crime. If you are under the age of 16 or unable to provide information due to a disability, a parent, guardian, or next friend may assist law enforcement on your behalf.
• The crime occurred in the United States or violated U.S. laws.
• You are admissible to the United States.

 

 

This part is also quite important:

 

The Form I-918, Supplement B, must be signed by an authorized official of the certifying law enforcement agency (PDF, 1.45 MB) and the official must confirm that you were helpful, and currently being helpful, or will likely be helpful in the investigation or prosecution of the case.

I had attacked and beaten by a gun through my head and eyes, I could die...and i have facial contusions in my face.  Medical reports: facial contusions in the face and a lot of anxiety and stress  from the trauma.

Your best bet is to contact your country's embassy if you need help getting home.

I would not think it very common that people who are assaulted while on short vacation think first about the chances of immigrating right after the incident---but the U visa is an option should one qualify. 

 

Did they catch the men who did this?  The U visa is based on whether you would be beneficial in the persecution of the individuals...the act of filing the police report afterwards would not qualify for the U visa on its own.

I agree.  After a trauma like that, most people would want to go home immediately.

I suppose it's something that gets thought about later on---only 2 days after an attack where I almost died (as OP says) my mind would likely be on other things, not immigrating to the country where I was just assaulted so viciously, but the U visa exists for those who need temporary immigration benefits where the person's ongoing presence is beneficial to the prosecution...he's eligible to apply of course, getting approved depends on particulars and evidence sent.

SB 674 is a new California law that took effect on January 1, 2016. The goal of this law is to ensure that all immigrant crime victims in California have equal access to immigration status through the U visa.

 

The classic one I remember and I am pretty sure it was California, Undocumented sic couple, got into a domestic and both claimed a U visa.

Exactly! As terrible as the incident is, it seems suspicious to not want to return home immediately unless you have a strong support system here, but even then they don't just hand out the U visas...

After an incident like that almost everybody I know would run home to be with the loved ones and of course would have a trauma....but going back to that “place” where the incident happened, scared to be at there and not wanting to live in that dangerous place. 

That’s me just thinking of course 🤔
