I have never heard of this being possible....but, when you are ready to file for Removal of Conditions on the 2-year conditional residency there is a section where you can fill out for VAWA. In this case, you would need to provide proof of the abuse (therapy sessions documenting his rage, police reports, photos of the abuse, affidavits from relatives on the abuse, hospital records/admittance regarding any abuse, etc.)

Are your conditional GCs already on its way to your address?

@Boiler it's only after your reaction to my post that I see where I faltered in my explanation 🤦‍♀️ 

I was thinking of it from a "not yet having GC in hand" scenario....my explanation definitely would get a confused look :rofl:

"When filing Form I-751 jointly with a spouse, the petition must be filed within the 90-day period before the conditional resident’s green card expires. When filing with a waiver after divorce, the petition can be filed any time after conditional resident status is granted and before the conditional resident is removed."

My wife and I have a friend who divorced her husband a few months after receiving her green card. She filed the i-751 (Removal of Conditions) with a divorce waiver, on her own without using an immigration attorney. She hasn't received an RFE or notice of interview yet.

Marriage: 2014-02-23 - Colombia    ROC interview/completed: 2018-08-16 - Albuquerque
CR1 started : 2014-06-06           N400 started: 2018-04-24
CR1 completed/POE : 2015-07-13     N400 interview: 2018-08-16 - Albuquerque
ROC started : 2017-04-14 CSC     Oath ceremony: 2018-09-24 – Santa Fe

1. You could look into your state. I know here in Texas, you could file your own divorce for like $300 and without a divorce attorney and save huge amounts of money (This works best if you just want the divorce and nothing because if things like property is involved, then I'd suggest using another option). In Texas, even if your spouse isn't cooperative, you still have this option but you can check on the box that asks that divorce papers be served by Sheriff's office for additional $100. This totals up to less than $500 and saves you all that money an attorney was gonna rip off you. However,  before you self-file, it is good to be at a safe place, of which I see you've found one already. 

 

2. Similarly,  there are local churches and NGOs that help you with this for free. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

And no, Green Card is going to be delivered to his mom’s and step dad’s address where we first lived. I trust the step dad, he is being supportive to mez
