Hi gurus, I received an RFE for using form I-864EZ. The rfe asked required us to use the correct form I-864. 

My question is - How do we calculate my wife's (sponsor/petitional) current annual income. She has two jobs, we have 6 months of pay stubs and letter of employment from both jobs. We are just confused about the correct calculation for "Current Annual Income". We are trying to avoid another RFE. Thank you very much for your help. 

PS. I can include pictures of her YTD from the recent pay stubs.

get a letter of employment for both of her employers stating her estimated annual income. It would be her average weekly pay x 52 weeks. Submit those with paystubs and fill in the amount in the corrected 864

 

we only had roughly 4 months of employment (I had resigned my position and my husband was working on his EAD) for AOS and did the letter + paystubs and had zero issues

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

I checked the letter of employment. Only one of the job stated her income. The other one didn't state how much she receives. Would this be a problem?

if she needs the income from that one to qualify for the 864, then yes, it will be a problem. Have them write a new one.
