Good day all.. in 2016 I travel to the US on a tourist visa and spend 3 month and some months later I was going back to the us I was dinied entry and my Visa was cancelled, and I was ask to reapply for a new visa. 2017 I applied but the Visa was not approved and I was giving a banned.. now am married to a US citizen.. my question is.  If she filled for a green card for me will the banned still stand?

How long was the ban for and for what reason? 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Sounds like a misrep so that would need a waiver, details matter.

You left out important details.  Why were you denied entry?  Why was the visa not approved?  What was the reason for the ban?  How long is the ban?

 

Nevertheless, if you have a ban, marriage does not cancel it.

Thanks for your help,  I was going for my cousin marriage, I was carrying $2000. The immigration office said I was carrying less money and they do not believe I will be going back.. they said I have some inconsistency in my story.. the Visa was denied for same reason of inconsistency..

If there is a ban, you will not be eligible for re-entry until that ban period has expired. I do not think a waiver would overcome this, but I could be wrong?

 

Once the ban has expired, you are free to re enter on an approved visa.

You red to go for your interview and let the consul officer tell you if you have a ban and what you need to do to over come the problem. I am in the same process now but you will never know until after your interview. From your story you might need the I601and I212 petitions filed after your CR1 interview

When you were denied entry and given the ban, you should have been provided a reason for the ban along with how long the ban would be in effect. Once you are denied entry and choose to voluntarily depart the US, the CBP officer gives you paperwork to sign stating that your deportation was voluntary and not a forcible removal. Do you recall getting any piece of paper from the officer at the airport?

Oteme just file your cr1 first, so when it come to the interview, you will be told what next to do by co and you will be told reason you are inadmissible to US by co,your cr1 visa would be denied bec you are inadmissible,the co will tell you to file a waiver,bec you are inadmissible to US,so next thing you gotta do by then is to get the waiver wave,once your waiver is approved, USCIS will contact the embassy you had your interview, and the embassy will contact you to come for your visa

They did not give me any paperwork

Refer to what is written on the cancelled visa.  That should give you  clue as to the situation.
