Hello

Here is my situation. I am a USC living in Germany since 1985 . I came to Germany as a military dependant got married and started a family. My husband is german and my children are USC. I would like to move back to the US with my family. The probleme is that I do not have a job in the US (no stateside income) and my husband cannot get a job until he has a Green Card. I have heard so many different things regarding me filing I-130 petition, some say I can with a joint sponsor others say I cannot. May father is in the US and would be willing to be a joint sponsor. The only proof of Domicile I could show in the US would be a Adresse and a Bank account, wich I am not sure is enough. If I am not able to sponsor my husband with a joint sponsor (my dad) what other options do I have to go back to my home country with my family? I would be greatful if somebody could give me some advise.

Yes, you can start DCF (which is the fastest way to bring your husband to the States). You can have a co-sponsor (your dad) and you can use your parents' address like US address.

My advice is if you want this process to be faster, go with your family to the Consulate in Frankfurt and file in person.

One more thing, I hope you did your taxes cause you will need your last year tax return, even if you have a co-sponsor.

All the best,

Adriana

If I am not able to sponsor my husband with a joint sponsor (my dad) what other options do I have to go back to my home country with my family?

Your other options are:

1) Either you or your husband find a job in the US from overseas.

or

2) You return to the US first, find a job that meets poverty guidelines for your household size, and then bring either just him or all of your family together over.

I had the same Problem, my husband (USC) is here in Germany with me and doesn't have a job over there, his family wasn't able to sponsor us but some close family friends are. So you are able to file DCF if you have somebody with enough income to co-sponsor your husband and llike already posted before use your Dad's Address :0)

GREENCARD the 2nd :0)

Surrendered Residency in the USA November 2005, returned GC, 12/2005 moved back to Germany (how stupid can you be?????)
