I am looking for suggestions, my husband is a US citizen and he is living with me in Honduras. I applied for a tourist visa to go and visit his family. we are planning to make Honduras our home but that could change in the future. he has applied for a residency in Honduras. my visa was denied the interviewer did not even open my file to read my supporting documents. she only told me that i needed to have my husband request for me from the US. I told her how could he since he is living here.  he is thinking perhaps he should apply for a CR1 visa. is there a quicker and better way than this?

She was assuming you wanted to immigrate to the US, hence the CR1.

Well I would like to have the option of living there but for now I would just like to visit. But it seems that perhaps the best approach is the CR1. That way maybe in the future if we chose to live in the US the door would be open to do so. But for now I would be happy just to be able to meet my husbands family. But it seems to be a waste of money to keep going to the American embassy in Honduras and for them to not even review my supporting documents this tells me they are not interested in allowing me a visa. I have nothing on mine or my husband’s record that would say we are not good citizens. I would like suggestions as to what are available options?? Thanks

Begs the question what documents you have that could be relevant to this application, obviously this comes up a lot and there is never a good answer.

 

If you want to immigrate then the CR1 would the option.

That I am a student at the university as well as having enough money in the bank to last for awhile. Also the fact that my husband has a car and his name is on the lease that shows he has been living here for a year and a half. In other words documents that help support the fact that I am not trying to go to the US to become an illegal alien

Unless you are planning to immigrate to the US in the next ~1.5 years, I wouldn't try for a CR1/IR1 right now. CR1/IR1 is not a "maybe we'll move to the US in the future" kind of thing; it's for you to immigrate to the US within the 6 month validity period of the visa (once issued), and if you don't maintain permanent residence in the US or don't immigrate to the US before the visa expires, you lose US permanent residency and would just have to start over in the future anyways. Maybe some of the family (mom, dad, siblings, grandparents?) can come and visit in your country instead or maybe find a 3rd country you would all like to visit that you could meet up in since it seems the US consulate isn't willing to issue you a tourist visa

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

This is the unfortunate result of people from your country (and other countries) who were not so honest about their immigrant intent.  The only options are to apply for a B-1 again at some point, or start the petition process for a spousal visa.

Your supporting documents should have been sent with application

The packet is reviewed prior to interview and a lot of consulates make the decision based on your application and supporting evidence

you will read here over and over that a CO does not look at the things bought to the interview

There is no way to submit documents with the DS-160. No documents are provided for a tourist visa.
