Hello, I have been filling out the I129F and getting the documentation in order for the past two weeks. It has been pretty stressful since there seems to be so much information scattered around that conflicts.

 

Here are my questions regarding the I129F and supporting evidence.

 

1) The instructions say to put N/A for any question that does not apply to you or NONE when it asks for a number you don't have. It tells me to not leave anything blank. So for example, when it asks how many children my fiance has, I am to put NONE or when it asks for my A-Number, I put NONE since I do not have one. I also put N/A for the preparers section, ect. Essentially I have nothing blank in my I129F, putting N/A or NONE wherever there is a blank (even in the state / province sections). Am I understanding this correctly? Will it hurt to have these there?

 

2) For the evidence of having met for the past two years, I currently am using a word document to organize the pictures from my phone and I have dates, location, and names of persons in the pictures typed under each picture. Is this acceptable? I have read differing accounts. Some people do glossy prints, others do printer paper. Am I correct in thinking this is not that big of a deal as long as you have pictures showing that you have met and they are captioned? The instructions are vague so I think this gives a lot of freedom in how to do this. I am tempted to just go do glossy prints from Walgreens and send them in also along with the word doc, but I like the idea of sending in only printer paper for a neater application.

 

3) My fiance is currently in the US on a J1 visa. There is NO two year residency clause in her J1. Will this be an issue when applying for the K1? She has to return home next March.

 

4) Do I really need to have a 'love letter' type of explanation for the circumstances of meeting explanation? Or can i just give the plain facts and leave the rest out?

>>> K1 means fiancee ready to marry>>> SO since she is in USA now, why you wanna do K1 when you can marry and do AOS instead directly in USA?  Save you the hassle of K1 and marry and AOS again?   She can also become a student and do AOS as a duration of stay F1.   Then when you are ready to marry, do a AOS to GC.   These are all legal avenues.   My fiance was a J1, she wanted to be a student, and I told her to do a AOS for a duration of stay but she wanted a multiple entry F1.. went home and got rejected F1 visa 2xs... J1 was also cancelled without prejudice.   Now is 8 months later, we just got the K1 2 weeks ago, 2 weeks later she will be back in USA again.    And what a journey when all her stuff is still here in USA.. no one expected her F1 in China to be rejected when she went back.  So dont let your fiancee leave USA, it is hard to meet up and you have to wait.   AOS in USA before she leaves.

Otherwise we would just get married in March and do AOS.

1.  Yes, this is fine.  I haven't done this for every single blank in the past (just the ones where it seemed important to indicate None or N/A, such as number of kids) and we've never had any issues with any of our applications.

2. I've sent glossy photos before (I put them in a Ziploc sandwich bag and clipped them to a printer-sized piece of paper to make the application easier to handle and to make it harder for photos to fall out of the packet.) I've also just sent multiple pictures on sheets of printer paper.  I think either is fine.  You can always bring originals on glossy paper to the interviews.  As long as the passport-sized photos are done exactly as requested (this is absolutely an application requirement rather than just evidence.) 

4. Nope, you don't need a sappy love letter.  Just a description confirming how you met and how you met in person.  I think ours was about a paragraph, and absolutely no sap or lovey dovey stuff.  They don't care about that.

Can they visit the US instead so that you can meet? That way you can marry her after meeting them in the US and start the AOS process.

 

If your fiance leaves the US, then she can't have preconceived intent to AOS when she returns. At POE, preconceived intent to AOS with the J-1 is 100% illegal.

Them coming here MIGHT be an option that we would have to discuss further. But for various reasons we both feel uneasy about that option.

 

With her current J1 in the Au-Pair program, she no longer has any vacation days so leaving to go see her parents and returning is not an option. The next time she leaves (either Feb. or Mar. 2020) her visa will have expired. Hence the K1 application now as she will need a visa to re-enter the country with. With current processing times it would put the wedding in August or September sometime.

Really, the easiest thing to do would be to have the parents come here to meet you and then get married (you could even do it while they are here) and adjust directly. Once she goes back, she will be unable to return (more than likely) until the k1 is issued.

 

I dont understand the parents having to meet you before getting married. will she NOT marry you if they dont like you? its her life, not theirs. They should trust her judgement. But then again, I'm 41 years old and dont care what my family thinks about much of anything, and live my own life LMAO

How old is she? What business is it of her parents as to who she marries? By giving in to her parents’ wishes you are causing yourself a lot of extra expense and stress. This is YOUR life, YOUR marriage, YOUR money and YOUR future. What if the parents don’t like you for some reason?

 

By doing a K-1 (the most expensive family-based process there is) she will be unable to work for many months when she arrives. Depending on the state, she may be unable to drive also. She won’t be able to leave for many months, so no overseas honeymoon, no trip home to see family or friends, etc. 

 

Just get married now and file for AOS

 

I had been married for almost 4 years and living here for over a year when my mother met my husband for the first time. We all survived.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

Oath: March 22, 2021 COVID-style same-day oath

I would get married and to the CR1 route at the very least if you are planning on her going back first.  That way she's not having to wait and unable to work for travel for 6 months, again.   But AOS right now is your best option.  

 

My mom obviously met my husband before marriage, she was the one who officiated the marriage.  But I didn't meet my FIL until 3 years in and my MIL and BIL until 5 years in.

I was on a J1 and we are currently in the process of K1. I didn't have the two year requirement either. I could've stayed but I decided to go home. I wanted my family to meet my fiancé, not for their approval, I just wanted to and he agreed. 

 

Our petition got approved -- I just provided a copy of my DS 2019, my J1 visa and arrival stamp, completion letter from my company, and I-94. This wasn't indicated on the instructions but I just wanted to do it for my peace of mind. Still waiting for our case to be sent to the embassy. I met a lot of people who filed for K1 after their J1 and had no problems. They were just asked what they did in the US when they were on their J1 and how long they stayed in the US for during the interview.
