We can apply for US Citizenship?

I've read multiple comments at Removal of Conditions threads mentioning how people applied for US citizenship with I-751 pending. But I never gave it a second thought because my wife hasn't been here for 5 years.

 

I just realized something wasn't right, that conditions are removed long before 5 years are reached and they can't have I-751 pending after 5 yrs (w/ rare exceptions). Quick Googling gave me two conditions on who's eligible to apply for citizenship:

 

1. A permanent resident for at least 5 years

2. A permanent resident for at least 3  and married to a US citizen.

 

I always thought #1 was the only condition. It isn't? My wife has been in the US for 3+ yrs, also received her 10yr Green Card last week. Looks like she's eligible to apply for citizenship, do I get it right? If yes, do we need to include more or less papers than the usual (5 yr) applicant would?

Seems odd to just her 10 year GC when she has held her GC for more than 3 years but yes she can apply 90 days before the 3 years are up.

She had 2 yrs (conditional) GC + 18 months extension letter while she waited for 10 yr GC.

 

And thank you for your answer. We'll start working on the application asap before new fees kick in

Yes. The requirement is 3 years living in “marital union” with a US citizen. I’d say you treat it as a mini ROC. Send in joint taxes, joint checking, savings account, credit cards statement, joint leases or deeds, electric bill, water bill, cell phone bills, .... Just easy stuff you can print off easily.

Advice was to submit a “mini-ROC” to demonstrate that right?  I mean there is a physical presence requirement, a residence requirement......OP’s original post however was about the three-yr vs five-year requirement while reporting that they are still married.

Three-year marital union was more accurate as the marriage needs to be ongoing, not just married on paper.

3 years as a LPR, married to a citizen AND in marital union.  

Married and living in marital union for at least 3 years prior to filing”.  See the uscis manual.

was aimed at the poster who kept on questioning why people use the phrase
