Common sense OR Gamble for Wedding date?!?!?

Correct. If he continues to be stubborn about the Feb 14 wedding and leaving the US for sister's wedding then he should pay for the I-485 ($1225) that will most likely be abandoned and the subsequent I-130 fee, NVC fees, USCIS Immigrant fee, etc. for the CR-1 process.

There is no requirement to marry with a K-1 visa...one can choose not to marry and go home.(beneficiary) or just stay single (petitioner).

That said, it certainly is not a time to figure out if you want to marry or not. Besides the obvious issue of signing an affidavit that you intend to marry already, the entire process is about 2 people who already want to marry, and 90 days is not nearly the time to figure that out or not, or to "confirm" what they were already thinking. It's for people comitted to marrying. Yeah, sometimes things happen and that falls apart, but that is not supposed to be part of the plan.

It is a gamble and I am not willing to plan a wedding on one of the most busiest days of the year for him not to be here by chance. Until he has a visa in his hands I dont want to make risky plans and claim a wedding date. March 1st seems more realistic but he thinks its insane because he believes those two weeks will make all the difference in getting his AP in time.

 

If anyone else has advice, please share down below.

Your fiancé is an optimist. That’s a good trait, until optimism = dumb decisions.
 

There is no, zero chance that a feb 5th interview in Sydney = a feb 14th wedding in the US.  Late feb, early March is more likely.  Giving time for marriage license application, etc good throwdown ceremony date is first week of March.

With that said, sister’s wedding end of June?  You don’t “marry and file AOS the next day”.  You marry, wait for the marriage certificate, then file AOS at soonest a week or two after the ceremony.  So - Earliest AOS filing date? Mid march.  Most likely?  Late March. 
 
Chances of making it to a June wedding?  😂😂😂😂😂 

 

This is really all about his sister’s wedding anyway.  
 

So choice:  Attend sister’s wedding and possibly start over or commit to yours/his, and send his sister a gift.

Yet another true-life story of why the K-1 is such a poor choice for many people. Thank you for posting this as it may give food for thought to others pondering the options who may find themselves in a similar situation of wanting to travel back home soon after arrival. 

 

He can leave the country before his AP is approved, the US is not a prison and we are all free to leave whenever we want. It’s getting back in that won’t be possible without AP or his GC.

 

We married on my husband’s birthday. The date was chosen deliberately by me so that he would never forget our anniversary. So far it’s worked well.

 

OP, you and I have the same birthday. We also share our birthday with Seal and Prince Andrew. As a Brit I used to be proud of my “royal birthday” but with recent events... anyway, you have my sympathy with a birthday so close to Valentines Day. My husband used to like to have flowers delivered to my office on my birthday but I asked him to stop doing that the year I took a train home from work on February 19 with a huge beautiful bunch of flowers and at least 20 people commenting on how my loved one “obviously forgot Valentine’s Day and is making up for it big time”.

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

IMHO, it’s a bit tight to have the interview on the 5th and in the states and married by the 14th. It took 5 working days (a week calendar days) to get my passport back with the visa, so you can’t even book the flight until you have the passport in your hand realistically! 
 

Unfortunately when you enter the K-1 visa he must be prepared to forgo everything else, as hard as that is, to concentrate on starting his new life. It sucks i know! I’ve missed my sisters wedding and the birth of my nephew, it was hard and still is, but it’s the choice I made and everyone understood it’s just the way this visa works. 
 

he may be having a slight panic and trying to make everything fit. I understand Cos I was the same way! Looking back, it would have been easier on me and my partner to prioritize us and the process and just accept somethings And just rolled with it. It’s kind of out of your hands a bit! 
 

good luck I hope for you he gets his AP quick and can do it all! But I would definitely not make any wedding plans until his flight is booked! I stand with you, better to err on the side of caution than act on stress!! It’s tough! Hang in there! Xx

I'll tell you to let him find out in the hard way because that is what my now wife did to me. I went for my interview ending of May and I got verbally approved and I insisted on buying my flight ticket even though she told me no but I wanted to be here by June 12 for her birthday. Almost caused a big fight between us then and she just left it alone; my visa wasn't ready till June 26 or so and I lost 80% of the flight money.  I also didn't want to file for EAD or AP with AOS because according to VJ people in my field office get greencard before combo card but she did the paperwork anyways and I have combo card and still waiting for my interview date. My wife was just laughing at me but I learnt my lesson.

me and my fiance have my bday, valentine's, wedding date/anniversary, and then her bday each week after the other 😅we just see it as time to take extended vacation all of february haha but i def understand

 

like everyone else said, might not have a green card that quickly though
