Curious if the kids were ever a priority why did he leave them behind to overstay his visa?... There is no two ways about it since he already filed AOS he must have put down his children's name. It is quite understandable that it will be hard for them to qualify for a B1/B2 or any other non immigrant visa because of intent. The only person that they depend on to take care of them left them behind, overstayed his visa and AOS. You will all have to wait it out, until the result of his AOS

You also need to make sure you have the required permission to remove them permanently from the country. Do the children even want to live with their father? My father walked out on my mother and us children for a new life with another woman. If, over a year later, he had come back to get me and take me with him I would not have been happy about it. He has not been in their lives for over a year and it’s not as it he was sent here with his job. He chose to walk out of their lives, chose to overstay a tourist visa here. He can’t work here so I assume he is not sending any form of support to them. Why is it now so important to have the children with him now when they have not mattered to him for over a year?

The children definitely want to be here and they are being supported. That’s not the issue. But I am looking into what I need to do about their entry into the US. Their mother hasn’t been in their lives since they were 3 months and two years old and they are teenagers now. We know she’s in the country but where?🤷🏾‍♀️. The kids are not being neglected but the guy that has them isn’t stern enough to manage them. That’s all. We will just pray that God speeds the process and we get them here with us.

Thank you. He did not overstay his visa intentionally but things happened and now we are married. The kids were with someone else at the time and now they are with his friend. They are not being neglected in any way just with someone not as mature as I think he should be. Praying it won’t take long

I am not sure what is going on, are they Fostered, who did the Court give control to? And does it allow them to emigrate?

The only way you don’t overstay intentionally is you have a medical emergency, and they tend to not last a year with you getting married along the way.

As an aside it’s not really surprising they need “stern management”, kids do tend to act up when they get abandoned by first one parent and then another, and then get passed around from person to person after being left behind. I know you are looking at all this from the perspective of your husband’s story, but objectively it looks different.

This is a good question. You can’t just have the kids arrive at the embassy and say “their dad says it’s ok to leave so they can”. The embassy will need to see legal proof that they are free to leave their home country.

Sounds like typical Disney dad. Leaves all the raising and disciplining to someone else while he enjoys his single life, going on overseas vacations without them, then pops up with two tickets to America and promises them a wonderful life here. What decent father goes on vacation without his children? Have you even met his children?
