I am so ticked off! We just got an RFE requesting this years tax transcripts and a letter of employment. First of all, I sent the stupid letter of employment, if they would look in the file. It has everything they are asking for on it. Second, I sent the package in February so I hadn't done this years taxes yet - I was too busy trying to get the package ready to send to them. I just ordered this years transcript so hopefully I'll have that in 10 days and can send this back.

Bad news is, it states on the stupid RFE that Abdel will not be eligible to get his work permit for 90 days after they receive the requested evidence. I sent them about 4 months of paystubs and bank statements, so they had plenty of evidence that I still have my job and am still making the same money I was the year before. It just ticks me off so much because I make enough to sponsor about 8 immigrants, so it isn't like I'm even close to needing a co-sponsor but this stupid letter says they can't determine if I meet the 125% requirement! I sent a huge amount of proof of income so I'm just furious that they didn't even seem to look at it. I wrote a detailed cover letter and bottom tabbed everything so they would have no problem finding it.

I wouldn't be so mad if they had just asked for the tax returns, but to make me have to get my boss to sign another letter is going to suck because I just got promoted, so I'll have to put a copy of my promotion letter in to show why the title and pay changed or just my luck they'd think I'm lying because I changed it.

I have a huge test tomorrow night to study for and now I'm all mad. This was not what I needed right now. Abdel is going nuts wanting to work so this isn't making him real happy either.

Ok, enough venting. Thanks for listening.

Liz,

Sorry to hear about the RFE and hope you can get back on track soon. It is frustrating process any route we have to take I think. Good luck.

This is really unbelievable how Casablanca is operating these days...they seem to enjoy giving honest people every possible reason to hate them...The lack of professionalism and consideration is something truly out of this world...They don't realize that the process in itself is stressful and exhausting...why cause all this unnecessary aggravation and burden...the lack of organization at that post is just sickening...I am sorry about your situation and I hope that you will be able to resolve it soon...stay positive ...even thought when dealing with Casablanca it is almost impossible...

Believe it or not, this wasn't Casablanca, this was Missouri. Jenn, did you send your 2005 taxes to them with your package? I didn't think it was necessary so early in the year, but I guess I found out it was. I guess they're rewriting the tax code too - taxes are now to be filed before filing your AOS. You're right Aymerlu, I want a job where I can rewrite whatever law it suits me to rewrite.

Still, I guess I should be happy, they actually communicated with me which seems to be more than most offices people on here are dealing with are capable of.

I got an RFE for proof of citizenship which was already included in the package as well...these guys really need to get their acts together! Are they sending out these RFE's for the simple fact of buying time?

Same deal for us. Although after having checked everything over, I'm afraid I may have neglected to include my 2004 W2. I'm not going to rush and do my taxes for 2005. It doesn't make sense that they could require those before April 15. I'm sending an updated employment letter (my first didn't include number of hours worked per week as they explicitly say on the RFE).

The good news is though that the statement about the EAD is less ominous than it sounds. If you look at it again, you'll see that it says interim employment authorization. You know how you can apply for an interim EAD if you haven't gotten it by 90 days past NOA1? Well now, you can't apply for the INTERIM EAD until 90 days after receipt of the missing evidence. They should continue processing the EAD as normal once they receive your response.

Hope it works out for you - I feel your pain!

Jenn, Why would you not include the 2005 tax year forms? Did they ask for that year? I would send in whatever they want so you will not get another RFE if they chose to send you one. just my 2cents worth.

Because I haven't done them yet!

It makes no sense that they could require 2005 IRS tax transcripts before IRS requires you to file your taxes!

My husband also sent just 2001 -2004 in.

Because he has not done the taxes yet.

Fortunately we have not received a RFE yet, but I am worried we will after your story.

Sometimes it also helps to include payment slips from your job

Good luck

And of course, going on principal alone, I wouldn't send them.

BUT, I'm not a risk taker, so I did my 2005 taxes this morning and photocopied them and my 2005 W2's to send in the RFE response.

I'm pretty sure they just wanted my 2004 W2, but just in case....

Grrrrrr... how annoying

So sorry to hear you both have hit similar delays in the AOS, Liz and Jenn. Hope you can get these last few hitches straightened out quickly.

I sent 2004, 2003 and 2002 tax transcripts and W2s, about 6 months of paystubs, 1 year of bank statements, letter of employment containing everything they asked for.

All they could possible want from me is the 2005 tax stuff. I guess I'll have to redo the letter too, just to prove that I still have my job! I am just so ticked off because I did the bottom tabs just like they asked for, and put the cover letter telling them what all was in the package.
