When I worked in HR (J1 visa), there were some people who can't access their I-94. I honestly forgot if they're from Ecuador, but their passport number was entered incorrectly. They have 2 kinds of numbers found on the passport (the other one looks like a passport number but is actually not, and when I entered that one, some came up, some didn't).  Sometimes they misspell the last name, or only put one of the two. I used to send an e-mail with a scanned copy of their passport bio page, visa copy, arrival stamp, and other documents related to their visa. I normally checked after a few days and *some* showed up.

 

I am not an expert regarding this. Lol. Just sharing what I encountered. I think it's better to go to one of their locations to be safe. Especially when she doesn't know how long she's allowed to stay.

Stamps are not always, or even regularly, issued to the passport nowadays. The online I-94 website is not perfect, but in the overwhelming majority of cases when traveling by air, it should show at least your most recent entry (if it was within the past several years) correctly. If not, and you want to know before leaving, you either have to go to a deferred inspection point or file an I-102 (paying the >$400 fee and waiting...possibly/probably exceeding the timeline to get a response before the I-94 expires). The deferred inspection site is the preferred path, obviously.

 

If she did ever want to try for AOS, she would need to provide an I-94 at that time anyway. She didn't travel by land so it's not like some cases (usually Canadians) where the lack of an I-94 entry will be excused...an I-94 is going to be needed here. And if not doing AOS, there is a nontrivial risk of overstaying, which has consequences ranging from bad (automatically revoked visa upon 1 day of overstay) to awful (3/10 year ban for 180+ days, or getting put through removal proceedings).

This ended up being what happened. I bit the bullet and called (multiple) deferred inspection places. Miami said "don't worry about it, it will be 6 months, trust me the I94 is there somewhere". Jersey said get to a def inspection point NOW and scared me badly. I finally called my local one to make an appt fearing I would be dropping off my love to be deported for no good reason...the guy fixed our problem over the phone. The original CBP agent had entered a different kind of document number (maybe a visa number? not sure). My new hero fixed it...i tried to find it on the website and we are GOLDEN for the next 4-5 months!

 

To some of the other posters, I am supporting her while she is here and our plan is to spend as much time together as possible, and then when she returns to her country 4 or so months from now I will be filing for K1 because honestly from reading this site and other advice I wouldn't chance an AOS here one bit...its just not worth it. I have some work to do to hit the affadavit of support standards anyway so we can be apart one more stretch. Thank you all for your help and opinions!!!

Following on from my last..

 

entered the country this this morning at LAX.. landed at 5:30am... just checked 8pm New Orleans time and my I94 has been updated already to show entry..

  • I-485 etc filed 23 April 2020 
  • NOA1 I-485 June 3 2020 
  • NOA1 EAD 23 April 2020
  • Biometrics 5 Jan 2021
  • EAD approved 12 March 2021
  • Interview Completed 24 March 2021
  • EAD Card Received 1 April 2021
