Hi All, I have a pending I-130/485/765/131 for my parent , and they need to go to India in January for some work related to their business.
Can I submit expedite request with financial impact to their business if they do not go ?
Would it impact their 485 if we say they have a business in India ? The financial impact I am thinking is the loss to the business if they are
not present there.

What are your parents AOS from? I am assuming tourist since you posted the question in this section but want to confirm.

I'm curious why you all decided that adjusting from a tourist visa was the best option for you, since your parents still have business responsibilities in their home country. Some basic research would have told you that they would not be able to travel for a while.

 

Of course you can always request an expedite, but I doubt it will get approved. Reasons for expedites usually have to do with the impact on the USC, not the immigrant.

This is why I asked to confirm if they were adjusting from a tourist visa. Because this is the risk they took when choosing this route. If they had such important business dealings in their country, then AOS from a tourist visa was a bad decision.

In a previous post OP mentioned that the parents have valid B visas, so I was assuming that's what they are adjusting from.

I am a firm believer in applying for an Expedite, however getting it approved is another matter so apply away but suggest he has a plan B.

No harm in applying.

Probably was not wise to AOS from a tourist visa if there were ties that needed to be wrapped up back home.

So you filed for you parents to immigrate and now you want to do an expedite and tell immigration they need to go back to their country to handle their business. Does that sound like someone who is immigrating. Where is the emergency for US sake. Also sends a big fat Red Flag for adjusting status from a Tourist visa. Because as a Adjudicator I will wonder will they even stay in US why do they need a green card if they have business outside of US.

To be frank, the need of the travel is not of any business, it is to attend to his mother's and his wife's death ceremony.  But can I give this reason to expedite the I-131 ?
