Wife is about to file N-400

I think we are ready to file, and planning to do so online.

Going through the checklist..

We have the following evidence:

front and back scans of her Green card

Scan of the front page of my Passport (USC)

Our marriage license

3 years of tax transcripts.

 

We have been married almost 12 years at this point. There are no previous marriages and no long trips. Only 2 trips abroad and both trips were under 14 days ( we have re-entry stamps in passport).  There has been no arrests or even traffic citations.

Am I correct in my evidence? or should I add more? Like bank accounts, etc? I just feel I am not giving enough. We also plan to pay using the online form. Will it matter if the credit card is in my name and not hers?

 

I really appreciate any replies and/or help provided. I just want to make sure I am giving them all they need. Immigration always stresses me out.

May 13 2008 (Day 1) - I-130/I485/I864/I765 Sent Via USPS for my new wife and step-daughter

May 23 2008 (Day 11) - Checks Cashed!

May 24 2008 (Day 12) - Received NOAs for I-130s/I-485s/I-765

May 27 2008 (Day 15) - Received Biometrics Appointment for June 12th @ 1PM at Tampa Office

June 12 2008 (Day 31) - Biometrics conducted in Tampa USCIS office also I-485 and I-765 TOUCHED!

June 18 2008 (Day 37) - I-130s and I-765 TOUCHED

June 24 2008 (Day 42) - That touch was actually an RFE letter being mailed. RFE for I-864 Evidence

July 16 2008 (Day 64) - Finally mailed back RFE letter with requested evidence

July 18 2008 (Day 66) - RFE Evidence delivered! Signed for by M. Miles

July 22 2008 (Day 70) - I-1485s TOUCHED and Received E-mail "Case Processing Resumed"

August 14 2008 (Day 93) - EAD Card Production Ordered!

August 15 2008 (Day 94) - I-765 TOUCHED

August 19 2008 (Day 98) - I-765 "EAD Approval Notice Mailed"

August 20 2008 (Day 99) - EAD CARD ARRIVED! - Applied for Social Security Number!

August 26 2008 (Day 105) - Received SSN - Took tests at DMV for License - Told license will arrive within 30 days by Mail

September 22 2008 (Day 132) - Received Driver License in mail - They sure took their time mailing that out!

October 11 2008 (Day 151) - Received Interview Letter for November 19th @ 7:00 AM

November 6 2008 (Day 177) - I-485s and I-130s TOUCHED

November 19 2008 (Day 190) - Had interview, APPROVED! Interview took less than 10 minutes

December 5 2008 (Day 206) - GREEN CARDS ARRIVE!!

Read the N-400 instructions.  It will tell you exactly what to provide and when.

I was under the impression she was eligible through the marriage. She has been in the country and we have filed joint tax returns every year. I would assume the 3 or 5 year rule would both apply. Shes been here 11 years, almost 12 come next April. With her longevity within the country, if a marriage filing is not accurate, then I guess the 5 year rule?  I can easily download additional IRS transcripts if necessary or provide bank statements, leases, etc for any time.

 

I am probably just over thinking the whole process.

Apply under 5 years, less scrutiny. If she has been an LPR all that time, paid her taxes and no rushes with the law she will

do fine.

Your profile suggests 'Adjustment of Status'. Which makes it seem like she hasn't been a permanent resident for 11 years..

My timeline is outdated. After receiving her conditional green card, I wasn't too active on the site.

 

We had our AOS interview November of 2008. She left the interview with the stamp and we received the green card in December of that year.

What isn't shown, was we removed conditions a couple years later. She was issued a 10 year green card. Her current 10 year green card expires in March 2021 and shows shes been a resident since 11/2008

 

I'll fix our timeline later tonight, when I get home.
