Durning My cr1 visa interview they asked for Adding support documents. Caz our income was 21k on recent transcrips. CO GAVE 221G  For Additional household  income i864A . but family cant sign they are work permit holders . but we have arranged  Additional joint sponsor. Should i include letter of explanation for not submiting household sponser paperwork ? is there gonna be any kind of problem ?

Your income is too low need a joint sponsor.   Provide an I-864A with copies of most recent tax transcript & W-2

OP states other household members do not have work permits.  He MUST submit a joint sponsor package instead, or there will be no visa.

Have to talk to the embassy about that, I didn't state to use the I-864A, I repeated what the OP stated the CO asked for ...

AND....the OP stated no additional household members had work permits.  That means there is no more household income to add.  As such, they will need a joint sponsor instead.  Best to understand the circumstances BEFORE giving advice.  No?

Actually says, "can't sign they are work permit holders".  Which either means they are NOT work permit holders or that they cannot do I-864a forms because they are ONLY work permit holders, NOT LPR's.  Either way, there is no more household income to add, SOOOO....they need a qualified joint sponsor.

AND ... like said.;   YOU best talk to the CO at the embassy ... he/she is the one that issued the 221g requesting the I-864A.   My advice was provide what was asked for in the 221g :)  

 

The CO may have asked for the wrong form ..  but you have to correct them, not me.

@Hank_ @pushbrk. @Danny10. Our income was 21.083. was only submitted 1 year transcript. He wasn't satisfied with our income and gave 221g that spouse's parents can sign i864a. But To sign Any i864 person must be green card or citizen. But they are work permit holders with pending  green card . My question was should i write a letter along with joint sponsor explaining my situation.

You should submit a joint sponsor that will enable the visa to be issued.  

A work permit holder cannot joint sponsor. 

So while the the 221g states this, you can't provide it and must do the next best thing and writing a letter in explaination wouldn't hurt.

Pending green card doesn’t mean anything. (Green cards can be pending for years, people can have their situation change and not get those green cards after all, etc.) You can’t “explain” if that is what you meant by explain. You can get people who currently qualify to sponsor, or you can postpone until those family members actually become green card holders.

Postpone is not in option. It can take years you know. Im just gonna go ahead with joint sponsor nd  tell Co that household members are not eligible

That won't help you.  If you have no qualified household members to combine income, you will need a qualified joint sponsor instead.

Yes I know it can take years... that’s why I said trying to tell uscis they have “pending” GCs is a non-starter. It’s not clear, do you have a qualified joint sponsor you can use? If so that’s obviously the route to go.

OP was trying to present the family members as being joint sponsor.
