Apply citizenship through marriage green card, husband owned tax before marriage, but couple do not own.

My cousin is going to apply citizenship through marriage green card, her husband owns tons of IRS tax before marriage. After marriage she did not work, just her husband worked and ran his own business, they filed tax jointly, did not own any tax during joint years. IRS levy her husband's bank account twice. She did not receive any letters from IRS telling her she owns tax, just a couple of tax refund letter shows $0 or $125 check refund addressed to her or to them. When she was applying removing conditional green card last year, she just filed returns and transcripts requested via IRS website. In this case, her husband owning tax issue will affect her citizenship application approval? Some people say account transcript shows too much information, return transcript should be better, that is true? How should she prepare the tax files for this application and answer questions during interview?

Generally, if one spouse incurs tax-debt before marriage, the other spouse is not liable. 

If the debt is incurred after marriage, then both spouses assume joint liability(unless they are filing returns separately).

 

Has she started to file taxes separately?

For immigration purposes the irs website recommends providing "return transcript". You can post another question on this site for this.

Thanks. your answer is the same to what she heard from her immigrant lawyer today. It should not affect her citizenship application. She is going to file joint transcripts for past 3 years. Before filling, she wants to make sure the transcripts are in good shape to file. What information should she pay more attention in those transcripts? "Amount due " shows 0, or other important key items?

You cant change any of the info, so it's a moot point what line to pay attention to.

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....
