You would do well to follow the (free!) advice you are getting from senior members here, with gratitude.  Had you come here before hiring an incompetent lawyer, you would already have known that the oldest son would not be eligible for a K-1, even if yours had been approved.

 

In the interim, you and the USC should both try to educate yourselves on the immigration process.  It is complex, time-consuming, and very expensive.  Read and research and come back and ask questions - that will improve the likelihood of an approval someday.

I understand you have faith in God, but no one including USCIS or US immigration is working against you... It's the law of the land that you need to obey and comply with the regulations guarding it...making an exception for you will mean injustice for alot of people... God does not side injustice.

I understand, honestly no one is disobeying the law and everything is done within regulations, trust me. But mocking God here is a different story.

I’m not the one still trying to get a visa, and needing to prove I won’t be a public charge. It’s wonderful that you have faith, but as you have already seen, you need more than that for a successful petition.

We waited for awhile for our turn, when we were called by consular officer. He started asking me questions. He refused to see our photo album when I tried to show him when I mentioned him about our Dubai trip with him.

Well in the end he told me that my son ineligible because of his age. And visa is not approved and we are returning it to USCIS for further reasoning. 

Then he said here are your passports and original documents. Which hd gave us back without any denial letter or instructions. 

 

Now our lawyer and my fiance they are all so confused our lawyer is so angry at them because they didn't provide us any denial letter or anything after the denial.

We are really confused and don't have any clue what to do next?

Lawyer will call the embassy and ask for supervisory review on the case.

Why he didn't provide us the denial letter?? 

I am also confused about my son's denial like this as he had ds 160 form name on appointment letter and medical records too.

 

Unfortunately Islamabad does not always give a letter with a denial.  If they do it just states the INA act on it and no details.  Even once  a K-1 reaches USCIS the only letter you may receive is the cancelation of the case.   

 

I would think real hard about the order of the interview, what questions were asked and how they reacted.  This will give you a pretty good idea on the concerns they had in regards to your case.   Before filing your Cr1 I would make sure that whatever their concerns are can be overcome.  

 

There is no way to know if the finical situation was a reason but it very well could have been a concern.  I know my family would be unable to survive on that annual income coupled with his age could have raised concern.  

 

Worse case scenario your husband to be comes to live with you while you figure it out.   My husband would love for me to be able to live in Pakistan during this process but I have young children who I can not remove from the states and need me.  

 

Put your heads together and come up with a plan.  This journey has been extremely difficult for us.  Some people get through Islamabad with no issues others have a long road.

You may be able to find a case similar to yours.

You'll get a better idea on how long this process is.  Even without any red flags, applicants from Pakistan have to go through months of Administrative Process(after the interview).

Please do your research before taking any step.

When people mention that enough may not be enough when it comes to finances, please believe them.

We got hit with this at a low fraud embassy because of my work situation, or lack there of. We used my mother as a cosponsor and even though she made above the minimum needed, the totality of circumstances had them ask for ANOTHER cosponsor. We did our K-1 with 3 total sponsors. While it's not the norm, if it can happen at a low fraud embassy, it can FOR SURE happen at a high fraud one.



Truthfully, I would say that your fiances age is going to be something they will look at, because in the eyes of the government, it is NOT your job to take care of yourself or anyone else when immigrating.

It's the sponsors job to take care of you, no matter how much you promise you'll do well or this and that. If they do not find the sponsor capable of long term financial support for you and your children, then it doesn't matter what you're willing to do. Yes, accidents happen and a sponsor could be hit by a car and USCIS can't predict that, but based on normal circumstances they can probably surmise that a 65 year old man won't be able to provide financial support for at least 10 years.

This isn't meant to offend, but for you to understand that this is the way the CO/IO looks at things. Their job is literally to judge your situation and decide if they like it or not. At the K-1 level there's a lot of discretion that is allowed on the officers side.

I don't see anyone in this thread "mocking God."  However, here in the US, our right to free speech includes that.

That's not something to be proud of, I am afraid.

 

But I know US is a great country and respects others' believes and values.
