Health insurance isn't an immigration requirement currently. Things keep changing..

Medical/dental is very expensive without good insurance in USA. It's definitely something you need to figure out with your future spouse. 

 

As others have pointed out, you and your kids will not be eligible for any federal aid.

 

What is your long term plan in the US? A big advantage of CR visa over K1 is the ability to work right away. 

 

How come you've not discussed these things with your fiance? Had your K1 been approved - what what you do? Perhaps the denial is a blessing in disguise..

He is a very hardworking man. I have met his friends they have told me the same thing about him that they have always seen him working.

So well, I don't think even at this age if he will retire soon.

Well, if we had gotten k1 we would work there in the US we had it planned and as I already know he works hard it would have really eased him given how workoholic he is. As a family we would support him and keep keep the boat going.

Usually takes a K1 6 months or so to get work authorisation, does not seem you knew what you were getting into.

Note that if you do get anything back, it will most likely be a very vague cookie cutter "not enough bona fide relationship proof". You may never find out EXACTLY that the issue is, which is why people here are trying to find the red flags in your case and what you should do next, because the governments denial letter won't give you specifics on why you were denied.

Oh and they don't have to look at anything you bring. That's why people recommend sending things that you may want to show them in the I-129F Package, because in some countries, the IO will just base their decision off of what they see in the initial packet, so their minds could be made up before they even speak with you.

In a case of high fraud countries like yours, it's recommended to front load it, aka send as much as you can before you even meet with the IO.

Health insurance within 30 days is not required currently, although medical costs + insurance costs are something the CO still considers in the totality of circumstances. Being above the minimum requirement allows somebody to be a sponsor. It does not mean it will satisfy a CO. Less than minimum = need a joint sponsor, above minimum = judgement call.

The minimum is necessary, not necessarily enough depending on circumstances. He doesn’t earn a huge amount more than the minimum required ($32187] - this of course assuming he has no other dependents in his household 

You may say he will work for a long time yet, but the CO will probably be more inclined to take normal retirement age into account. 

what work experience do you have, seeing as you will presumably take over the main breadwinner role at some point ? Your younger kids still have a good many years left of you needing to support them. Health insurance is expensive and regardless of whether you need to show it upfront for immigration, you need to have it, you probably have no idea how expensive US medical procedures are. (If you need surgery for something unexpected, the total costs of surgeon, anesthetist, hospital etc could easily be larger than your husband’s annual income.  You really need to be insured.)

It's really strange our silly lawyers kept saying age at the time of petition counts.

Oh well, we are really torn up and devastated by this refusal and I am really discouraged to try even for cr1 route.

Having such a blessed relationship and in the end all we get is refusal from a rookie consular officer. :(

May God saves everyone from such mishaps.

 

Not likely a rookie at a post like Islamabad.

 

Lawyers are renowned for getting things wrong.

Honestly, it is not much to support 4 people.  Especially since at 65 he doesn't have that many years of employment left.

And since this k visa got rejected because of age difference. I feel that the cr1 route will have the same issue. :(

You cannot file for a spousal visa until you are legally married.

 

And it is not just age difference - there are many red flags in your case.

I am an experienced beautician and run my own parlour here.

I would do my best, and above all the main provider is the God.

Check what you need to go to be licensed in the State you are going to.
