Need advice on I751waiver

I'm considering going for i751 waiver cos my marriage is not working out. ( long story) 

I have as evidence :

1-Joint insurance 

2-Joint dental insurance 

3-Joint car insurance 

4-Joint tax return 

5-Joint bank account 

6-Joint phone Bill on the sam phone plan 

7- I have her as beneficiary in my retirement plan . 

8-Receipt plan ticket and hotel with both name on it in Hawaii ( celebrating our marriage anniversary) 

9-Picture tougher and with familly on different event ( Halloween.  Christmas 4th jully ..ect ) 

10-Screen shot of our conversation 

 

M I having enough evidence? 

Divorce  was her decision not mine . 

Should I hire a lawyer?

I noticed that you didn't mention about the Lease? did you guys have a joint lease ? I also think for people to be able to help you you need to specify If you already have the divorce decree or If you still living together ....

And no . I dont have a lease cos we were living with her brother . 

Yes we still living together 

No divorce decree yet.  

Can I fill without the divorce decree until I have it ?

I don't know a lot about waivers but I'm sure some other people here will help you more. But you definitely need to prove to USCIS that you were living together. Maybe a letter from her brother. do you have the same address on both of your Driver License?? did you receive mails to the same address over a period of time?  If you also have friends and family that can write affidavits to prove that your marriage is real and you guys were in a real relationship.  Regarding the waiver I'm not sure if you can submit a waiver if you don't have a divorce yet.

You can file without the final decree. You'll get an RFE for it in a few months.

Thanks for your reply.  

And no we dont have the sam address cos she didn't renew her drive licence yet . But I still have lots of mail with  the same addresse for both of us.  Can I  use that as proof instead ?
