You’re right, people with a connection to a banned country weather still living there or not, are vetted harder. We’ve been in AP for 16 months now because of this. 

16 months in AP seems a little excessive.. you could have processed CR1 in that time

Yep, we definitely could have. We had no way of knowing when we started the K1 process that the travel ban would come up in the future. Unfortunately if we had gone with the CR1, we would have still run into the AP problem we are experiencing now. Can’t change where you were born I guess 🙁

*Visitor's visa interview: December 2016, called back by embassy for second interview on same visa application in January 2019 - visitor's visa finally issued May 2019.

 

*Fiance visa placed in administrative processing September 2018.

It is just the sad reality for pretty much everyone from a travel ban country right now, whether they are CR1/IR1 or K1. Because of the travel ban it's not uncommon for those in or from travel ban countries to experience a year or more of AP

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

AP is AP, regardless of the visa.

Dual citizens are not subject to ban. There are certain iranian men especially who have served in the IRGC who will be subjected to an outright refusal under 212 a 3 b. But they should no longer be subject to administrative processing under PP 9645. Some might have extended AP but not all. This is on basis of the changes in the past 3 months. Up until July everyone - children women elderly were subject to extended AP of 1 to 2 years. Starting in July extended aps are the exception rather than the norm. Especially for people who have not served in the military or worked for the government

Hi,
I am a dual citizen (Iranian-Canadian) and my visa request was denied during the interview yesterday and now I have to deal with AP. I have never ever served in any kind of military nor touched a weapon in my entire life and I was exempted from the military service in Iran. Also I have been in the US for 23 times during the last few years without any problem and as a Persian-Jew, I'm pretty sure that I do not have any tie with the Iranian regime.
So it's not just about the Iranian men who served in military. It can happen (and is happening) to people like me as well.

I am so sorry to hear that, My husband is Iranian Canadian, his case just transferred from uscis to NVC for CR1 visa, he might have a same issue

It’s a frustrating situation, that’s for sure. My fiancé has a similar situation to yours. He’s Iranian-Norwegian, has been to the US successfully many times in the past as a visitor, and is Christian. 

 

We’ve been in extended AP for quite some time. 

 

I wish you you luck on the journey and hopefully an issued visa soon.

Hopefully it doesn't happen to him (or any other people who are apart from their spouses). I have IR-1 and got married only a few days after the travel ban in the US and when I was crossing the border, I declared that the purpose of my visit is to get married the next day, the officer talked to his boss and then let me in. I have never had any issues at the border and I found them very respectful and nice. I don't know what was the motivation of putting me under an extra vetting process and I understand the importance of it, but it would be better if they asked me to fill out the forms in advance and prior to the interview.
Also my wife and I are going to China to see my family and we booked our ticket from NYC, now I don't even know if I am allowed to cross the border or not :(

I was told during my interview that I am exempted from the Travel ban because of my Canadian citizenship, but apparently I wasn't that much exempted. I guess the only thing that I can do at this moment is to provide the information they asked (which I did ) and wait. Hopefully they check my info and come to a conclusion soon! :)

Hey guys,

I was supposed to receive a formal form (DS-5535) within 48 hours and need to fill it out and send it back, but the only thing I got was an email, asking for more information (like travel history and work experience etc) which I provided and then I received this email yesterday:

Also my Case Last Updated changed to Dec 11 as of yesterday.

Is it how it usually works? I mean is it normal that instead of DS-5535 they simply asked me to reply their email with the requested information?
