Recently Expunged Criminal Record

So, I received a misdemeanor DUI about 11 years ago. I submitted the appropriate court records when I filed my I-129F several months ago. I got no RFE regarding these documents.

 

Just recently, I got this record expunged through a lawyer, and I received the court order for dismissal of my case (successful expungement). Now, I was wondering if I have to present these documents (or rather my fiance) to show that my case/record status has been updated. I mean I will still carry the expungement documents to the interview, but is it worth submitting them if they don’t ask about it? 

 

Also, my fiance is aware of my past conviction. She just brushed it off as a youthful mistake. Just in case there were some people who may wonder if she is aware.

take the new expungement records, though it isnt really necessary. they are likely to ask about the DUI and having HER be able to explain it and provide the expungement is a good thing.

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

Yeah, that’s what I was thinking! I’m going to have her prepare what to say about the expungement document just in case.

May I ask what specific court/police documents you submitted with the I-129F? I submitted my I-129F yesterday, am very nit-picky about it, and would like to compare. I have a DUI from 13 years ago. Thank you.

They are basically checking for child related felonies.    Now, at point of application, you had a record and had submitted court certified copies, thats fine.  you had been upfront and honest and its not a deal breaker crime.

 

Expunge or not irrelevant already as they know and you showed it.   But just bring to interview in case they ask.

 

USCIS just redefined GMC good moral character as 1 or less DUI.  2 or more is not GMC.  This is for N400 naturalization info in case you didnt know.   Just came out few days ago... not relevant to K1 at this point.

Since I’m overseas, I simply accessed the local county’s website which had my records. I printed them, and I also attached a brief paragraph explaining the conviction.
