My wife's son arrived to live with us via F2B visa couple weeks ago.  We just applied for his SSN.  I have health insurance through my employer's retirement office and my wife is covered through it.  My step son is 28 years old.  Any suggestions on health care insurance for him.  Not possible for me to keep up with all the ever changing govt. laws.  Any suggestions?  Any consequences for him if he gets marketplace insurance or Affordable Health Care Act insurance?

 

He will be looking for a job when he gets his driver license, but there is no guarantee he'll get insurance from any future employer.  So we are looking into this now.

 

Thanks for any help and suggestions.

Another question (not sure if I need to start a new topic),  is he a household unto himself, or must he include me and my wife as part of HIS household and thereby count our income as part of his?  In other words, if there is a question on any application he fills out about "household" income, will he have to include mine and my wife's income?

Depends on if you want to deduct him as a dependent on your taxes, which WILL make him part of your household. Talk to your accountant before the immigrants fills out any forms for health insurance.

Well as you said things are constantly changing with this. Currently he is a GC holder. There is no additional public charge assessment for him in the future. Currently he is eligible to use marketplace and any subsidies they may offer him. Marketplace varies by state (depending if they extended Medicare or not or have their own state programs offered) So he will want to start by going to the main marketplace website and entering his info. I believe right now is open enrollment however even if its not he will qualify as its a 'new life event' (his immigrating). If you have trouble with the website you may want to consider using their contact us feature to find a walk in assistance center to help with the application..

 

He most likely will not be able to use his moms insurance due to his age but you can look into it as well. For marketplace his household size is going to be determined based on his tax situation. Are you guys going to claim his a dependent? Will you be providing more then 50% of his support? If so then yes, marketplace will consider your household to be 3 and income from all 3 - even though hes the only one getting it. He probably wont get much if any of a subsidy and rates are about 1000-1400 month on average. If he is going to file his own tax return as a single person and no one else will claim him then he is his own household and will be size 1 and income for 1. Just because you share an address does not make you the same household. 

 

There was wording at one point where someone had to make a min amount of income to get subsidies however now the wording allows for immigrants to have 0 income and still get the subsidy. The subsidy is calculated with how much income you have currently but you also need to take in to account how much you will exactly make that year. You do not want to apply with 0 income and take a huge subsidy and then earn a decent wage where you get a lower subsidy as you will have to pay it back at the end of the year on your taxes.

Wonder why he would not get Insurance through an Employer.

 

I would also suggest he visit the OCare Marketplace and see what his options are.

That is the ultimate plan.   He is looking for employment.  We are picky as we want him to have an employer that offers health care and other reasonable benefits.   In the meantime, we'd like him to have some insurance.

Thank you for this info.  No, he will pay his way, food, help with utilities, etc.  We have no plan to claim him as a dependent.  He's always planned to file his own tax return as single.  I think at this point we will have him create an account in healthcare.gov and see what shakes out.  Until he gets employment, he income will be zero, of course.  He his actively looking for employment and studying for drivers license exam.

Welp, that just killed my beer buzz.  The wife doesn't want her son to have anything to do with Obama care (or whatever they call it now).  She's thinking of some minimal coverage like emergency room and some other stuff.  Not sure I know what shes talking about.  For sure, we want him to have an employer that offers health insurance.  But in the meantime, I dunno.

Well the important thing is that they have it sorted, would be interested to know what they are going with.
