Should I notify USCIS that I’m no longer with my ex husband after filing to remove conditions on his green card

Hello all, I don’t know if anyone has ever experience this but I recently got a divorce from my ex husband after filing for his adjustment of status. Our marriage was just not working out despite efforts on my part to make it work. I met someone when I visited my country this summer and I have plans of filing for him in the future. I don’t want my ex husbands filing to affect my plans of bringing my fiancé . So my questions is should I send notification to USCIS that I no longer want to be part of my ex’s filing or just wait to send the divorce decree when I file for my fiancé. My ex husband is giving me conflicted stories about his permanent residency card, first he said he has an interview next year, and recently he said he has also already received it before the divorce was finalized and he’s not showing me any proof of this. I don’t believe it to be true since we haven’t attended the interview to remove the conditions on his two year permanent residency card.

Timeline

You mention both adjustment of status and removal of conditions, so which is it? If he already have his conditional greencard (which I assume he does) then you're still on the hook for the i-864 affidavit of support, meaning you're still his sponsor no matter if you're divorced or not. So in this regard you might be affected when you bring your new man here, as you will then sponsor TWO immigrants (so you have to earn enough for that or find a co-sponsor).

 

On what visa did he enter the US and when did he file for removal of conditions? You can notify USCIS but there's really not much you can do otherwise, he can still go through ROC on his own with a divorce waiver. He could have been approved without an interview too, it's very common with interview waivers for ROC. And like I said, you're still his sponsor no matter what.

I meant to say removal of conditions on his green card. I understand that I am still his sponsor and I don’t have issues with that as I earn enough wages to support up to four people. We filed for his ROC early June and we divorced September of this year. I just don’t know if I should remove myself should in case he still has to attend the interview or just wait to send the divorce decree when I file for my fiancé. Thanks for your input.

You can remove yourself. They will RFE him for the divorce decree. ROC is currently taking about a year or more so i doubt its been approved yet.

Thanks for your input. Should I send a letter of notification  or wait till I file for my fiancé to send the divorce decree which will be before he has to go for the ROC interview.

You're divorced and planning on petitioning someone else. If youre going to do it why are you waiting.  Theres no guarantee there will be an interview.  Roc interviews arent common.
