Hi, everyone, I have some issues and I would want you to help me out here, My spouse wanted to file tax last year and he asked me for my w2 and I told him that they hadn't given me at work, he asked the second time and I replied back that they haven't given me at work and he told me that he cant wait for me that he wants to file his own tax and he will file it married, filing separate and when I get my w2 that I should file MARRIED SEPARATE TOO, so when I got my w2, I file married , filing separate and the next day the office that helped me file the 2018 tax told me that IRS had rejected it because my husband had already filed married jointly, I was so furious because he never told me that he filed jointly because he didn't want me to know, we have been having our issues and problems but I didn't believe he needed to lie about that, he ended up adding me to the 2018 tax without my knowledge and there was nothing I could do, Dec 30th 2019 I got a letter from the IRS that we owe $1200 in taxes and they did the broke down, my husband file 0 income for me in 2018 and he knew that I was working , he also reduced his own annual income for the year 2018, now the IRS is saying that we are owing $1200 and we need to pay, I was so furious and I had told him not to ever add me to any tax no more now that we are separated, that we both should file separate but he disagrees but I am not giving him my w2,i don't know what to do now, I don't want him to add me to his tax, I had to sign up for Norton life lock because I don't want him to use my information to do anything shady, my fear now is that the tax he filed jointly in 2018, that is part of the documents I submitted with my VAWA petition, I hope nothing pop up, and I need your advice what do I do now with the letter from the IRS office, I don't want to report so he doesn't get arrested and probably goes to jail but am so scared that he doesn't do the same thing again, please advice me, I didn't know when he filed the 2018 tax jointly, the money he collected was not deposited to our JOINT ACCOUNT or any check MAILED TO OUR MAIL BOX, am still wondering how he collected that money, now we are both indebt of $1200 with the IRS, please I need your advice.

Once your I-360 is approve you don't need Prima Facie (prima facie are temporary this is why it has expiration date on it).  The approval notice (permanent) is all you need to applied for FAFSA, they will not assume your VAWA is approve just by showing an EAD C31 category. To get Federal Aid you must show your I-360 Approval notice.

Did you sent the I-130 receipt with your VAWA case? If you did they will do it.... if you did not sent your I-130 receipt with a copy of your I-360, they will do it... reminder if your abuser was an LPR is useful if your spouse is a US Citizen will not make any difference.

no i did not send it. 

Yes my spouse is US citizen. So you are saying it is not gonna make any difference? it is not gonna make my case faster?

Not at all, Priority date is useful for LPR spouse who need a visa to applied for adjustment of status, this is why Priority date is use for. Their category is under family preference. 

US citizen spouse don't need to wait for visa or priority date to be able to adjustment of status they are consider immediate relative.

Yes priority date in Vawa cases will not fasten your time, this is just useful on the AOS as I mentioned before only to LPR spouse.

@sandranj @Stillwinning!!!😊 when I check my case status on save ..it tells me that my case has been returned to the DMV ..what does that mean ..cause the DMV refuses to renew my drivers license cuz they said they were unable to verify my extension letter ...now the case number they gave me say the case had been returned to the DMV..I need to renew my drivers license so bad ..I can’t be driving with expired drivers license..I just can’t wait to become citizen and let all these things be bygone ..is too much of nerve wrecking ..please I attached the picture to see what am actually talking about ..like when do you think The DMV would be able to verify my extension letter ..thanks God bless you ...

Take a trip back there (DMV) I'm sure it'll be ok now.

Mehn it’s not easy USCIS can make life difficult for someone ..I stopped putting my mind too much on my case I just hope for the best ..cause at the end of everything someone won’t even be taking all these documents to heave after we die ..so I can’t just be thinking too much about this ..I just wanna do what is right and leave the rest to God ..that’s it ..what will be will be ...once you get to know that life likes to make some one looks miserable then that’s when you will be better so I don’t worry anything they do doesn’t bother me ..I just live my live happily that’s it ..anything that comes my way I face it cuz I know life is a battle field ...thanks once again
